OPP charge passenger with impaired driving

In this case wouldn't the trials have to happen at the same time to work? If one gets charged as being the driver wouldn't the other be off the hook? Can two people be charged with driving the car? I'm assuming that the grabbing of the steering wheel might be hard to prove as the only witness has something to gain by saying he wasn't responsible for the crash.

Just wondering. I am by no means knowledgeable in how courts work.

Quite the opposite, actually. They would likely want the trials to be separate. If there is evidence to support charges against both people, then both could be tried. I suppose that both could potentially be found guilty of the same crime though anyone who had that happen, then didn't try to appeal, would be pretty foolish.
 
The defense:

I should have locked the bastird in the trunk. Then he wouldn't have grabbed the wheel causing the accident. Then the police wouldn't have known I was driving suspended.

The goverment made it illegal to drive with someone in the trunk so it's all their fault. Arrest McGuinty.
 
Too bad they did not post the whole story. Cops should have ensured that eihter the complete story be told, or none of it published. There is obviously more to the story than what was published.

Are you serious? Jesus Christ man.... the cops didn't publish the story the paper did.... LOL.... It's the paper's responsibility to ensure the story is correct before it's published.... This just goes to show you how ANTI-cop this board is....

Dude, do you realize that bear is most likely a cop (based on nickname and previous posts)? In any case most people on this board agree with the cop's decision and disagree with the reporting. The criticism is at the PR handling as the story as published by the media needlessly reflected badly on the OPP. I have to admit that the criticism was a bit unwarranted.. The media will take the whole truth and turn it into what sells.. Actually these days they don't even need the truth.. They can lie all they want without any legal repercussions.
 
What if the passenger was a licensed G driver 'teaching' the beginner in the driver's seat? Wouldn't that be considered impared?
