Ontario: Its illegal to even hold a cell phone now

So i can legally change the song playing on my car radio, but if my cell phone is plugged in to my radio and im doing the same im breaking the law?

Exactly - they always had a "distracted driving" law that was never enforced and the new cellphone law isnt enforced either.
 
I'd be more happy if they actually enforced it. So many idiots chatting away on their phones while driving its mind boggling. Today a girl was holding up traffic on the QEW because she was texting and looking down the entire time. Guess she felt it was safer to drive slow and text than just drive.
 
An Oshawa woman, Khojasteh Kazemi, had been charged and convicted in 2010 of holding her cellphone after she'd picked it up while stopped at a red light. A provincial court judge later overturned that conviction but the Crown appealed.

I still see a ton of people driving around while holding a cell phone despite the law change. Some won't ever learn unless you hit em in the pocketbook.
 
How about them holding an MP3 player or GPS?
What is the phone feature is off but they use the phone as a GPS?

Let's get real people. There is a reason they set the limit of $125 or whatever as the penalty.

If you wanted to stop it, it's real easy.
$1000 and 3 points for first offense (first time will be at officers discretion for fine and or points depending on the stupidity of the person and danger they posed at the time...gives the person a little slack/chance :)

$5000 and loss of license for 1 year on third offense

I suppose you think the death penalty stops murders too. It doesn't matter the consequence, there will always be people that do what they want.

You said the problem would be solved if the fine was a lot higher. There would still be a problem.
 
If I was driving when my cell phone went off, I pulled it out of my shirt pocket and handed to a passenger asking them to answer it I would be guilty of the charge. This is how I read it.

Thanks to the M/C saftey course I avoided being t-boned on the bike a month back when a texter ran a red so I have no sympathy for cell phone drivers.

The problem with this judgement is that it just keeps reinforcing the notion that having something in your hand makes you a bad driver. The real problem is that when you get into an intense conversation your mind focuses on the conversation not what's on the road in front of you. There is also a lag in getting back into an alert drive mode after the conversation ends. Oh yeah where was I? Oh on the DVP doing 40 KPH straddling 2 lanes.

The present law is a smoke screen to pacify the ignorant.

True, the "I just dropped it" claim is an easy cop out for anyone caught using but where does common sense come in?

Is there any proof one way or another that the woman was actually using the phone or was the case to set a precident to prevent the abuse of the excuse. This has all of the vague implications of HTA 172.

If you have a cell phone on the seat of your car and a cop sees you scratch your ear he could charge you based on what he thought he saw and there is diddley squat you could do about it.

A cop can push a few buttons on a phone and tell if it's been used in the last few minutes. No need for this Nazi BS. If you refuse to allow the cop to handle the phone it's like refusing a breath test. No mercy.
 
As much as I am 100% against using Mobile devices while driving this ruling is as ludicrous as one can get.

Like speeding.... everyone does it, including the judges who made the silly ruling. Would love to peek into their heads to see what went on when they were debating it.

But I am sure it's okay to hold and drink the iconic TM coffee, right?
