Just to clarify...the device I bought is not a whistle in the traditional sense. It doesn't rely on air passing through it...it actually generates its own sonic impulses, electronically. Here's how it works...
If it relies on ultrasound, it's useless. Infrasound, maybe. Deer have a more narrow hearing range than humans, IIRC. They're herbivores with ears tuned to hear large predators like wolves, bears and cougars, none of which make ultrasonic noises. Felines and canines do hear some ultrasound as smaller prey animals tend to make noises in that range, often from under cover or in the dark.
Imagine the confusion those whistles must cause to neighborhood pets. They're the equivalent of driving around with a vuvuzela blasting away.
