Don't lawyer up, it will get costly probably as much or more than a relocation cost.
Have and HVAC technician come by your house for an estimate and see how much relocation would be to run lines along the side of the house to the back and just pay for it to get your sanity back or just don't open your window at night.
When we bought our townhouse, the AC was located on the rooftop patio just above the master bedroom and that goes with every other townhouse in the complex and we can hear our neighbours and even two neighbours down but not as bad. Problem is that there is not a single thing we can do about it, you grow accustomed to it. We have an air ionizer which we run at full blast when we go to bed and the white noise is soothing to say the least.
The problem with my situation if I run my AC it resonates and we can either move it or install a ceiling fan and hope that it helps.
