I would tell him to take it up with the contractor, you wouldn't be liable for someone else's work. Even if he named you, you didn't put the dirt on his side, so they could easily remove you from the claim afterwards.
If he wants to make a scene, his only plausible way would be to go after the contractor.... and even that doesn't mean he deserves a NEW driveway. He just deserves a quick patch up job to put it back in the original state that it was in before the damage occurred.
Definitely civil matter
by the op's post, he talked to his neighbor, which means he told his contractor it's was ok to use the driveway, so the op is still responsible not the contractor, they were just doing what their customer told them to do.
