Lost control of a vehicle in difficult weather conditions, got a ticket...

a parking lot at one place i worked at had some freezing rain & snow conditions happen to it. parts of the parking lot were unsafe to walk on never mind try to park in at this point. one driver got stuck, not because the snow was too high but because when he would try to inch forward he would be headed sideways to one car, when he tried to go backwards he would slide sideways and nearly hit another car. he was not going more than a km, it was just that slippery. he had to be pushed out of the way by some people because he could not go forward or back out of the driving area of the lot, but conditions in that spot where he got stuck looked exactly the same as the rest of the lot that he was able to navigate freely... 20km is pretty slow (though some of the ice roads are slower), but you can still end up sliding around...
 
If a slope is involved, even a small one, then that can be an issue.

My little brother was in the back of a car that went slowly down the Centennial North campus hill one morning.

They were going very slowly, but still managed to slide down most of the hill and just stop without hitting the car in front of them.

Then they saw someone start down the hill much faster than they had. What do you do when you know that someone is going to hit you, but not for another 30 seconds?
 
I can see how people really have hard time imagining how slow 20 km/h is. Try it. There's 20 speed limit around my complex, it takes focus and trying very hard to modulate your throttle to not go faster. It would have to be really steep slope, ice and I don't what. Anyways .... point is that if someone is in a traffic and is just slowing down, it's usually nowhere near 20. Surely you can slide, but rather a foot or two ...
 
See I don't understand how people that have some kind of intelligence can not realise that you can be driving very carefully, continually testing your braking capability at very slow speed as I was and suddenly have a few meters of black ice where you can slide no matter how carefully you are driving.

If that hasn't happen to you, then I suspect you don't get out often

If you lost control of your vehicle because of the road conditions then obviously you were not driving according to conditions.

Similar things have happened to me, but only because I mis-judged the conditions and was driving too fast.
 
For all those that have seen cars unable to move on ice or slipsliding down hills, what tires were on the cars? If you are on 3 or 4 year old all season tires you don't have a chance. Hard to imagine the difference until you drive on real winter tires. A lot of insurance companies give discounts to those that use winter tires, another reason to use them.
 
if weather was truly a factor the officer probably wouldn't have issued the ticket knowing full well you had a valid defence; black-ice is somewhat of a defence, it's unforseeable and spontaneous ... but if you were in the white stuff, JP won't buy it

having said that, you might be able to plea-bargain with the crown to HTA infractions that don't carry demerit points, a popular one is the 144 (12)

Years ago I was driving under similar circumstances on a side street. Approached a stop sign on a down hill section of road and slid up to and right through the sign. There was a cop parked up the street who flagged me down and gave me aticket. I was furious and spoke to a cop friend and he said ask these questions in court.
Do you have your notes of that day with you?
answer:Yes
How many tickets did you give out at that stop sign that morning?
answer: xx ( really cant remember but it was several)
At what time did you phone in for a plow or salt truck to remedy this dangerous condition?
Answer: I didn't phone in
The cop was dressed down for writing tickets and making no attempt to serve or protect the public, my case and all others from that morning were thrown out.

i don't see how it's the officer's responsibility to call in the city to clear the side-street, even if he did the city would probably tell him they'll be by later in the evening

most municipalities clear side-streets at their own time, i know they have weather minimas before they splunge their budget

either way, what if: kids, pregnant women, mother w/ stroller were crossing the intersection where you claimed to have sliden through? oops... i'm sure after years of therapy and riding the bus you'd learn you could have driven for the conditions

Lost control of a vehicle in difficult weather conditions, got a ticket for improper right hand turn.

Person driving under 20km/h was making a right hand turn. Slowed down and proceeded to make a turn. During the maneuver the person lost control of the vehicle resulting in the vehicle going over the center line. The vehicle stopped on the opposite shoulder.
The snow on the road and no salt had a direct impact on the event.
The ticket given was "right turn - not safely" 141 (2)

If the person pleads not guilty, what impact will weather condition have if used as a line of defense?

If the majority of other traffic was able to manage without doing the same kind of slide at that location, then the only question that remains is, "why were you the only person so affected" by the weather and road conditions that you are trying to use as an excuse.

Unusual road conditions "might" be effective as a defence only if they were so unusual that the majority of other traffic was so affected by an unexpected, unusual and highly localized road condition, such as in the following clip. However, even then any potential defence can be neutralized if it can be shown that you deliberately ignored public announcements warning of severe driving conditions and road closures. I don't know..for instance, I was driving on the highway yesterday morning, road was wet, went around a big off-ramp where it goes under the other highway..so it's in shade, can't see that well, I slowed down because I was expecting some different traction there..as it turns out, it was semi-ice and snow covered..had a bit of a moment but saved it. I can see someone else might have gone off the road. I mean, you're going from a totally wet, salted surface to that in the space of a second or two..you just never know.

So you support the police existing solely for making money, as opposed to keeping the public safe? I called a police station once because their officers had set up a seat-belt check in a blind 2-lane downhill corner giving people about 4 car lengths to either brake or get out of the lane the cops were blocking. Yes, you should be able to stop for ALL possible situations..but really, do they need to set up a dangerous situation just to burn people for a seat belt infraction? The sergeant understood completely and I've never seen another seat belt check there in 7 years..

What kind of car do you drive thou? Winter tires?

My truck has pretty good traction control, and Ive hit black ice on the highway at 120km/h and all it did was swerve a little with a few beeps from the traction control keep me going straight and on the road. And many times in the winter Im sailing past cars at 60km/h, and yet the cars can barely get going in the snow...Sometimes I cant get going in 2 wheel drive in heavy snow, pop it into 4x4 and Im flying out there

Just saying I think it really depends on the car and what kind of electronics and tires it has

I have winter tires..it's a Civic..no fancy electronics but you're right, some of the new traction control systems are very good. They say the new Corvette's are best left with traction control on although I had no problems when I beat one a couple of years ago. I remember someone was on here a couple of years ago bragging about he could never possibly lose control of his car/bike because he knew how to ride/drive or whatever. I think that's fairly arrogant..one day I might go around a corner and there's diesel on the ground..or mud from a construction site..you just never know.

"Driving according to conditions" also means knowing when to leave the car in the driveway because of conditions.

Give me a break! Some of you guys should be camped traffic cops! On snow days you can hand out tickets for just being in a damn car!

It's everyone's responsibility! Not all dangerous conditions happen at the same time city-wide, the city may be able to spare some resources to take care of a particularly dangerous area if they are alerted about it.

Either:
- Someone is still on summer tires (driver's fault)
OR
- Speed was higher than stated (driver's fault)
OR
- Driver doesn't know how to drive (driver's fault)
OR
- There's something else we're not being told.
