Nope. There's an exception in the HTA to allow for that.

(6) Subsection (2) does not apply to a person who is transporting speed measuring warning devices in sealed packages in a motor vehicle from a manufacturer to a consignee. 1996, c. 33, s. 12.
Speed warning devices are not prohibited by federal law, so Ontario has no power to stop their manufacture in the province. However, Canada's Constitution does give the provinces the power to regulate transportation matters, and it is through those powers that Ontario can regulate and even prohibit their presence inside a vehicle on Ontario highways, just as Ontario prohibits the mere presence of another legally manufactured product, alcohol, within reach of the driver.

small claims court wouldn't work for me, it's not worth it because the unit bearly cost 70. small claims will be much more. I wonder why no paralegal built a case law based on the legal fact of receiving radar signal in ontario vs the proper testing of the rd

You got off a charge that would of cost a minimum of 100$ and a max of 1000$ and you're trying to get a 70$ piece of equipment that you said yourself isn't very good?

Give yourself a rate that you believe your time is worth.
Let's say 50$/hr.
This means if you spend more than 1.5 hours trying to get this piece of equipment back, you are literally wasting your time.

I understand your point and I accept it as very true fact.

For me, I wouldn't bother for 70$ especially if I had a "better, undetectable" one. Not because I give up to the law, but because I wouldn't bother using it again, so let them get rid of it for me.
OP says he plans on giving it to someone he knows in an area where they are legal, so all the power to him.
I wouldn't know where to start because I am sure if he called the police station, they'd give him the run around and say "they are illegal, bla bla bla".
Rob's suggested mail/email response is the best bet in my opinion.
