Hey guys, my fiancee and I just had a new born and I forgot to freakin renew my stickers. I just got pulled over today. whats the best way to fight a invalid sticker ticket. I know it doesn’t carry any points, and I don’t want to have a ticker on my record.

In Toronto, they give you the option of first appearance. If it's the only ticket you got, they will typically drop that if you show them valid stickers and give them your story as long as you didn't get ticketed for anything else. If you did, they will require for you to plead guilty to one of the charges.

didn't get a ticket for anything else ****** was behind me for about 3km guess he didnt have anything better to do then pull my plate

In that case, it should be a lot easier. Told you how it usually goes in Toronto (renewed stickers in hand and sob story on the lips for meeting with the prosecutor), not sure about Peel.

got the ticket in Toronto. Dufferin and Liberty. So I have to go to court here (Toronto). Is the wait time the same for This kind of ticket compared to something like speeding. I remember the wait times in Toronto being like almost a year.

You're not going to court, you're going to first attendance. It usually doesn't take very long for them to give you an appointment for that. I have showed up for this exact reason, expired stickers ... the prosecutor was a lady that was not taking any **** from anybody, I started seriously doubting she was going to let me off, but she did. P.S. Get the sticker NOW ... it helps your case if you are arguing that you just forgot.

Im going to try and get in at lunch if not tomorrow morning at the speedy by my house.

By the way, I appreciate everyone’s quick reply To this kind of thread. I know its not a crazy kind of ticket but I've been ticket free for the last 5 years and Do not want something like this on my record.

Thank you guys.

Cheers Fil.

Best thing to do is get it renewed today. Tell the prosecutor why you forgot and just show the prosecutor that you owned up and got it the same day of the offence. This will most likely drop your offence.

If they offer you a plea deal for something less, i would flat out reject it as you will STILL be considered guilty. At this point request a trial and hire a paralegal (if you need to). From here hope they will spoil the ticket (which is more than likely)

best of luck.

so on the ticket which option do i go for "court date" or just "meet prosecutor"?

I'd take it to the courthouse (most likely the one at the YCC - Eglinton/Keele) and at the reception they will throw it in the slot.

If the sticker was barely expired (September 2013), renew it and throw the "just had a baby" story in. If the sticker was from 2010.....:lmao:

Nothing better to do other than his job, I guess.

It's an absolute liability offence, meaning there's no defence; you either had the sticker or you didn't. As mentioned by others; your only way to avoid the conviction is to throw yourself on the mercy of the Crown (after getting your sticker TODAY) and see if they'll drop the ticket for whatever reason (sympathy may work). If they don't drop it and this goes to trial, as long as there's no fatal errors on the ticket, you WILL be convicted. The JP can't elect to give you a break on the charge; if the evidence is presented properly they HAVE to convict. They CAN give you a break on the sentence... but that's not what you're looking for.

You still have the holy trinity - noshow, disclosure, 11b if it needs to go to trial.

Sorry to hear you got caught. When I was younger my friend never had valid stickers because his car would never pass emissions. He never had a problem in 8 years of driving. He is better off now so he just does it for peace of mind. I have always thought of it as a cash grab that only punishes the poor. The emissions part anyway.

honestly The prelude has passed every year I have had it done. Just been busy with the house and new baby, and I just keep saying i'll do it next weekend and next weekend.

Cops are still working during the court hearing. Theyd never do a no show unless he's required in two places where hed be present in the more severe conviction.

the 11b is really tough. Just hope your trial just keeps getting delayed until its valid to file an 11b.

Try talking to the prosecutor first. If the prosecutor doesnt toss the ticket, file for a trial.

So how does it work? when I go down to book the court date I can talk to a prosecutor BEFORE booking the court date and see if he will through it out right then and there?
