I just got in an accident

I am still in shock. Happened around 12:27pm I think.

Bay St going north just after Queen. St East and before Eaton's parking entrance.

I was on the outside lane and a Beck taxi was next to me on the inside lane. I was accelerating pass him and suddenly he starts merging in to my lane.

I was going to hit him if I don't stop or slow down. Panic and gripped the front brakes. Lowsided on the left with the bike. Taxi kept going.

Engine scuffed up. Lost my left mirror.

I called the non-emergency number as I wasn't (edited) seriously injured. I was instructed to bring my motorcycle to the Collision Center.

I have a few witness. Notice two security cameras that may have captured the incident.

I don't know what to do. I can't think. What are the proper steps to take here? I read these types of posts 1000 times but I can't remember them atm.

Thank you.

Hopefully you are ok. AFAIK, if you didn't hit the other vehicle, then it's attributed 100% to you. Depending on damages, may be best not to proceed with an insurance claim... Even if you did proceed with a claim, your own insurance company pays for your medical benefits (if any) and your vehicle damages/repairs under DCPD part of your policy, less deductible, and assuming you have collision coverage. If you did get video evidence, then it would help to 'attribution' of the collision and may reduce your deductible.

Hospital to get checked if you think you may be hurt.

Collision centre, if you want to go through insurance. I wouldn't for what you've described. You will very likely to be found at fault if you claim it.

Go to the reporting centre, make sure you provide all details available.
Contact insurance to let them know what happened, and about the security cameras as well.
Then go to the places with the security cameras and see if you can get the footage (if they even work).

If you don't get the other driver on camera / find him then you may be dinged as a single vehicle accident and it can go on your record. Unfortunately sometimes I think it's best to hit the guy merging into you, but I know that's not ideal.

Glad you made it out relatively unscathed but I think this needs to be done ASAP because those cameras may overwrite their stored info on a set time.

Glad you're okay.
Take a look through this see if you can find your scenario. See section 10, sub section 4. Rules for Automobiles Travelling in the Same Direction in Adjacent Lane
(4) If the incident occurs when automobile “B” is changing lanes, the driver of automobile “A” is not
at fault and the driver of automobile “B” is 100 per cent at fault for the incident.

Great PDF! I'll save that to my computer.

However, in order for the second driver to be fined/assigned fault you have to find him and prove that it was him/her. Otherwise there's no one to blame.

Bingo! I think we might have a winner. I was leaning that way initially. If he didn't touch you, then you lost control. Harsh but true.

Leave a virtual paper trail outlining how it happened and clearly not your fault. It's the least you could do. If you need a character reference I'll pm anybody on your behalf. Oh wait, you're the wrong number Iceman. N/M

Hello everyone,

Thank you to everyone for your help. I am home now.

I am just a bit sore atm. I didn't report to the CC yet. I guess I am leaning towards the decision to let this incident go.

Don't think I can really do much at this point. Really bummed out.

Thank you to everyone for your help and concern. Gonna rest now.

Sorry to hear about the accident. Get well soon man.

At fault accident, dont claim it, winter is here now just take it as a lesson learned and fix the bike yourself over the winter. I made one claim for an at fault accident many years ago when I crashed my bike, insurance was so easy paid for everything and cut me a check for my bike and my gear fast, even asked if I wanted to start a claim for my injuries (road rash). Sounds great right! Yeah until I got my insurance renewal and it was $8000 a year...LOL

Don't do it! If I could go back I would have never made a claim

Would need proof if no contact like vid footage? GWS.

Ding Ding Ding. We have a winner. This is a single vehicle collision. There was no contact with the other vehicle, (even if he/she were morally wrong). You saw the cab coming and as you yourself stated "I panicked and grabbed the brakes" If you report and claim this then your going to be awarded 100% at fault, and therefore paying higher premiums for several years to come

I concur, will be deemed at fault 100%.

For sake of conversation, if he did get hit and the taxi didn't notice and kept going wouldn't he have been stuck in the same situation because "he didn't get his plate" that I hear so often in these crash threads. Seems like bikes in general get screwed more.

Yes, bikes get the raw deal. You gotta have your a-game going all the time...

You need proof of the other vehicle involved, otherwise anyone that crashes on their own could just say "I was hit by a car, but I didn't get the plate"......Doesn't matter if your on a bike or in a car, Id think its the same
