I've heard a similar story about two people. Guy1 lets guy2 ride his bike. Guy2 crashes his bike, destroys the bike, a parked car, etc. Guy1 claims that he never gave permission to guy2 to use the bike. Guy2 is pretty ****ed up from the crash. Guy2 gets charged with theft.

I'm guessing that ended Guy2's friendship with Guy1? If it was indeed a theft, I don't think Guy2 can claim the injuries. If Guy2 actually received permission from Guy1 to ride the bike, then he should be going after Guy1.
 
Well thats where stuff gets sticky. Guy1 reported it as theft, so therefor regarding insurance, it is seen as a theft. Guy2 still has to be convicted and proven guilty of theft.

I'm guessing that ended Guy2's friendship with Guy1? If it was indeed a theft, I don't think Guy2 can claim the injuries. If Guy2 actually received permission from Guy1 to ride the bike, then he should be going after Guy1.
