How to handle speeding ticket 20 over

I used X Copper to fight my Careless Driving charge and we won that.

I recently got a speeding ticket for 20 over the limit. Cop reduced it.

This is my Correspondence with X Copper.

I recently got my first speeding ticket for 20 over on my motorbike.Curious to know what my options are. This was a 70 zone



Location Westbound on Gardiner expressway off ramp to lakeshore blv. Looked like a 100 zone.

The prosecutor can ask for the charge to be amended to the original speed. We can still attempt to have the matter withdrawn or reduced further. If those options are not available, we will then enter a guilty plea as is so the prosecutor cannot bump the ticket up to the original charge.

Please advise how you would like to proceed.
 
What info are you looking for? X Copper provided you the correct information (although I'm not entirely sure about the pleading guilty option, TAFB runs and pays instead of letting it get before the court, I haven't personally come up against this scenario).
 
Is it worth fighting it?

Or do i just go to the prosecutor myself.
 
i see these paralegals all the time in action. The vast majority of them never go to trial, they are about quantity not quality. going to trial takes a long time so they will do all that work for one ticket which is not worth it, instead paralegals will spend 5 min in courtroom a, do three tickets for 3 customers, then go to courtroom b and do the same... they usually plead guilty to a lesser fine which is what usually happens
or they will say that they asked for disclosure and never got it so that the case is dismissed, or hope the officer never shows, both happen a lot.

they dont do anything you cant do, just have to know the ins and outs of fighting tickets. go to old city hall and sit in a courtroom for an hour to understand how they do things. very simple.
 
He clocked you at 121? and knocked it down to 120? That is not knocking it down.

The minimum: go to court and ask the crown to knock it down to 15 over (no points) $57.50 and you are out of there.

Otherwise see if he shows up and go from there.

He clocked him at 121 in a 70 and knocked it down to a 20 over. That is about as big a reduction as you could hope for.

And OP, I probably wouldn't be fighting this one, unless you think you have a VERY solid case! If they amend it back up (which they WILL do), your insurance company will treat it as a MAJOR ticket!!!

No case.. totally my fault. Long weekend, got carried away with fighter jets flying over my shoulder. Felt like mavrick

Okay the OP says he got stopped for going 20 Over in a 70 zone? But then he says he was doing 121? It can't be both or am I an eegit reading it wrong. Don't answer that...

So why wasn't his bike impounded under HTA172? Cop was having a nice day? Cop couldn't do the math?
If the OP fights it and the court bumps up to the original charge, would he lose his ride then?

Apparently they can't do this. If they amend it up, it's still speeding. They can't tack on racing/stunting after the fact ;)

more likely the cop said he was going 121 to make him feel like he was getting a favour.

three possible reasons.
1)a stunt driving charge is a lot more work for the officer, i.e. about 1.5 hours of paperwork, plus could have been busy on the road that day so didnt want to have to wait around for the tow truck etc.
2) a nice guy cutting someone a break
3) 51 km/h over is very close to not being a stunt charge, so may not want to lay such a high charge when is so close to the limit

He wont have his bike towed after court, the officer can only do it at the scene or in the case of a pursuit etc after you catch him.

the stunt driving charge can be charged 6 months after the fact so yes the officer could re-lay the charge, unlikely but possible, Unlikely the court would as its a different type of court for stunt driving, the same one that accident tickets, suspended drivers etc go to.

I think that will confuse him all the same. Lemme see

1) OP got a ticket for speeding
2) OP was doing 121kph in a 70kph zone
3) That was 51kph over (loose your bike city)
4) Cop was having a good day and reduced the the ticket from 51 over to 20 over.
5) OP is thinking of fighting it
6) OP is advised to pay the ticket and NOT fight it.

Thinking about it there should be notes like this after 3 or 4 pages on all threads.

Was the ticket reduced by having the big "R" on it? How would prosecutor know it was reduced.?

Could OP still take it to court and see if cop shows up?
