Sounds like hes legitimately trying to help. I would go with your gut feeling with what is fair. Honestly, I would personally say $1,300 and then tell him how hard it was to get around on my bike. Then also bring up that you can let the insurance handle the matter if he'd like. I'm pretty sure he'll cut the check for $1000 only because of the fact that he doesn't want his insurance rates to go up. Honestly, Sounds like a legitimate guy... dont think he's going to screw you if he admitted to hitting the bike like that lol.
 
I did actually lose time off from work because I was unable to get to work. The bike is my main form of transportation up until the winter season really. A bus trip to and from work for the day would cost me 3.75$ there and another 3.75$ back, 7.50$ for the day; I work at a min. wage job that pays me $10.25/hour. On top of not being able to take my bike to school also adds onto the 12$ for the GO fare which is roughly the same amount for a full tank of gas on my bike, a full tank can last me around a week for a 40km trip 2-3 times/week. But of course, I'm not going to make him pay for that ...

I've got in touch with him over email and sent him a list of detailed and priced parts of what I have currently fixed and he has requested for the picture of the front fairing (which isn't all too bad to be honest, but the fitment isn't right because a piece of it broke off from the fall), and my clutch lever has been bent and scratched but I continued to use it anyway. The total amount is around 800$ now ...

A similar incident happened to me. Someone saw the bike get hit on the street and they left me a note with the licence plate number. Similar damage. I called the cops.
The officer called me and explained he would not charge the driver with leaving the scene, if she agreed to pay for the repairs. I charged her for the fairing and the broken lever, throttle grip. She paid, end of story.
 
nah, just ignore it and pay more money.. this is the GTA, where people pay $500K to live in a condo smaller than my garage.

That one boggles my mind also.

..and higher maintenance fees and taxes than it would cost to maintain 5,000 sqft house. ...and the legal liability and financial responsibility of the entire building...
 
A year ago today, my ninja 250 got backed into at my work parking lot. He was a regular at my cafe and stopped showing up after he had hit my bike. My bike had a lot of cosmetic parts damaged, but I only replaced what was necessary at the time because I didn't have expendable cash to make full repairs ...

I replaced the left fairing panel, the left tail fairing, the gear shifter, the left mirror, and the front fender ...

- The left fairing panel, tail, and gear shifter came to 397$ in OEM parts.
- I was lucky to get away with the mirror (aftermarket on eBay) for 47$, a friend of mine sold me her front fender for 50$, another buddy of mine was able to give me an extra left turn signal (free) that was also smashed.

What I didn't fix was the front fairing (slightly scratched), where the headlights are, OEM costs 226.26$. As well as the shift lever, OEM is 28.22$.

My questions are ...
1) I am not able to provide an official invoice for the front fender since it was a cash transaction between my friend and I, would an email suffice?
2) Could I make him pay for the things I didn't yet replace because I didn't have the money to (but have a quote for the parts)?



Don't even bother trying to negotiate with the guy. If he took off and avoided your for a year, he's obviously not an honest person, and he's not interested in doing you any favors, nor should you be interested in doing him any.

If you know who he is and where to find him, file a claim against him in small claims court. You have plenty of evidence on your side. Civil matters are not like criminal. All you need to do is show that he is more than likely responsible and the onus is more on him to prove that he is not. Some affidavits from witnesses will also help your case.

What you should do is file a claim against him for the cost of parts that were damaged. All of them. Get an estimate from the shop and have them also include time for additional repairs. lastly, you should include compensation for the time spent working on repairs yourself at an hourly rate comparable to what a shop would cost. This is more than fair and the court would agree. The point of a judgement would be to restore you to the same financial situation you were in before he damaged your vehicle. Your loss of time should IS worthy of compensation.

He sounds like a decent guy, I want to give him an opportunity to pay up before I bring it to court. I'm currently only asking for the compensation of the parts and not the labour (I've quoted him for what Speedworx would charge me per hourly rate)... Although, I really want to pinch every penny I can get out of this situation :rolleyes:...

a decent guy wouldn't have taken off an avoided you for a year. He had an opportinity to clear up it a year ago. He didn't. How much leaway can you extend to someone. Just sayin.


I would also suggest contacting your insurance company if you haven't. Perhaps pose a hypothetical question to them. Now that you have identified the other driver and have proof that you were not at fault, they may very well likely pay the claim and waive any deductible as you were not at fault. Anything you have already paid for can likely be reimbursed. Assuming you have not waited too long to make the cliam.

Did you contact your insurance company when it happened?
 
I don't mean to **** all over your plan, but the reality is that when it comes to money, most people cannot be trusted. Especially strangers. It's important that you be proactive in order to PROTECT yourself financially. It's okay to give people the benefit of the doubt at first. Sometimes they can surprise you, but you can only extend that so far before you take the necessary steps to cover youself.

Like I said, make a detailed list with OEM quotes and parts for everything. If you really want to get him good. Take your bike to a shop and have them make a list on everything that needs fixing ( plus the stuff you fixedc before) The bill should come out to be in excess of the 1000$.
There you go, you can make him pay it, or just settle for slightly less and send him on his merry way :)
 
This story lacks info for your curiosity m'dear ... However, the story ....

. I ended up filing a police report that day just to have a record, and the police claims that he can't charge him with anything since it is on private property (some of my research begs to differ as it could be a criminal charge for leaving the scene of an accident, and not an HTA, not sure how true this is?).

I too thought H&R was a criminal charge and if so criminal charges can be laid on private property. You can be charged with dangerous driving in your own back yard.
However I have also read that in order to be found guilty you not only have to have done the deed but intended to have done it. The damage itself would be have been accidental but the running was deliberate. If the person didn't know they hit something they could get off but he left a note. Does that exempt him?

Wow.. you really have a knack for crunching numbers. Are you an accounting student? If not, maybe you should consider changing profession : )

No I'm not, I'm in Disaster and Emergency Management lol Maybe it's just the Chinese in me that wants to count every penny :p

I would just like to give a quick thank you for everyone and their input! The guy is paying out 800$ in parts damaged which is all I'm asking for, he was extremely cordial and timely in taking up responsibility for his actions. I do however need to sign a affidavit stating I am going to receive the money and once I have, I will not file claims on insurance in regards to this incident with him.
 
Was it actually a year ago or just under? If it's less than a year you can ask for whatever you want and if he declines you can still make an insurance claim against him.

Edit: Nvm, didn't read the whole thread. Glad you got a good resolution.

Good for you... signing the "affidavit" is customary, but make sure you read and understand the terms... it is not really an affidavit, it is a contract.

Honestly, you only had a "he said - she said" situation, and on top of that, it is one year later. He had a pretty good chance to deny it in court. He proved to be an honest guy.
