OP, if something like this ever happens again, get the person's driver's license number, insurance, etc. Even if they swear up and down that they'll pay cash. At least as a safe guard against getting screwed for the repairs.
 
I called the guy and told him i got 72h to file a report , and that the money should be tomorrow. He dosnt seem to care which way it goes rly.
sigh... You live and lean . that's all i got to say. Next time i know i would call the cops.

Having said that, I would not let him get away with the money-later scheme .... cash now, or his license plate and insurance slip. Anybody who can drive has 400 bucks, it's nothing nowadays .... 4K would be a different ball game.
 
Well at least you have gained something from it,never ever trust anyone there is no honour in society nowadays as far as your leg just as Nearance stated might have been worth something at least a few paid days off work,

Do you have their numbers? I would file the report, with witness statements, and make sure to include the ****er admitted to drinking. You don't have to say when he admitted it. He's a scumbag. Say he smelled like booze.

Agreed. Go and file the report so long as you have some of the guys info.keep a record of this incident because for all you know he's doing the same saying you rode into him. I had a similar situation in my car and the guy said hell pay then when he saw the bill he changed his mind. I told him I'm going to file report and boom he magically had the money available. If you smelled booze (IF!) then include that in your report, if you haven't don't.

Unfortunately some people are scum and their word isn't worth a dime but there are still some honest folks out there.

At least $1000 if you went through insurance. I know, I've been through a similar situation but I called the cops. Yup, you totally played this wrong. BTW a "a couple of beers" from a guy that's okay with drinking and driving equals at least twice that.

If I could get out of that jam for $400 I would immediately go to a bank and either pull the cash or borrow it on my credit card getting a "full settlement" signed receipt. He got off so light.
While some might see your actions as noble you aren't doing society any favours in the long run.
 
#1 Mistake the OP made. Riding in Brampton.
#2 Mistake the OP made was not turning this guy into the police for a breathalyzer.
#3.Mistake the OP made was trusting an idiot who would drink, drive, have an accident, and try to get out of it.

This guy can deny any involvement in this case, and you don't have a leg to stand on.

Well, it is pretty scraped up, I guess you can stand on it.

With injuries like that, any lawyer could get you a few hundo's for personal injury.

I think you will get $0.00 out of this guy.

I rear ended someone about 8 years ago. Very minor damage. Older gentleman was very upset with me. I begged him to not go through insurance as I was only 18 years old. He trusted me and I paid to fix his car.

2 years ago a pregnant woman rear ended me this time roles reversed. I got me car fixed in one afternoon.

Not everyone is a scammer. Lets not give up on humans yet. There are a few honest guys left
 
The problem with this situation and with everyone who's saying that the driver may not have been drunk and might not be a scammer.

You can't take the chance.

-He changed lanes and almost killed a biker.
-If he was drunk, he needed to be caught
-If he was drunk and you let him go...he could have killed his family as well as another family.

"Red watery eyes, and shakey nervous behavior." He is possibly impaired and an officer needs to get their ASAP to see if he is or not.

The OP seems to realize all this and says next time he'll call the cops, but everyone else on here who's leaning away from that need to smarten up.

A minor fender bender with 2 cars is not the same situation as a car turning into a motorcycle and causing damage to body and property.

If there is any, any suspicion at all that someone is impaired. (that is Drinking or drugs) then you need to call the police and get it checked.

There are too many accidents out there as it is....and way too many impaired drivers too.

We've lost enough brothers and sisters.


To the OP. I hope you heal fast and he pays up promptly.

well ... i missed my work today because of my leg , hard to walk since i work in construction.

as for making a claim i will pass , its too late now. If i do make a claim he will probably deny it since there is no damage to his car. and i will be stuck with my increased insurance. ( i dont even know if witnesses seen the hit, they prob seen me fly )

I hope some new riders here will learn on my stupidity

i will update you guys on whenever he pays or not on Thursday
 
Also OP if you go to sell your bike at soome time in the future and someone asks if it has been in an accident what do you say? Even insurance doesn't compensate for decreased value but as you are now finding out the costs aren't all that evident at the beginning.

I hope you're OK for work tomorrow and the guy pays you.

Also thanks for posting the details so others can learn. You sound like a decent guy that was just a little too kind. No one wants another person to lose their licence and then maybe job and house for DUI or anything else but no one wants to lose their life either.

This topic comes up on a regular basis and I was wondering if it was worth making a sticky of either a particular post or a summary of what could happen. It's something one needs to read about before the event. There are times where a bit of forgiveness and understanding is a good thing but not always.
