Got booked for 5 km/h over!

Sounds like some of you are saying that if its a reduced fine, I should pay it off to avoid trouble?

If it was reduced, it can go back up in court. Disclosure will tell you the original speed. If it increases to 15 over IIRC you are still <$100 and the revised speed won't make any difference to insurance.

Well, if it was reduced significantly then pay it but in this case I suggest you fight it, the risk is not that much if it is only 15 over. When I got caught 27 over and it was reduced to 15 over, then I paid it.

No, I think that he just wants to make sure that you know the possible ramifications. If the ticket was reduced from 15 Kmh then the only additional issue would be a higher fine, as points start at 16+ Kmh over the limit. Did he mention what speed he actually clocked you doing?
 
That's ********. Takes 3 years for the ticket to be wiped, 2 years for demerit points ( luckily you didn't gain any ). Still Bern, that's crap, and like everyone said, as long as it's 49 and under, it's all the same to insurance.
 
I just wanted to point out that these are not valid arguments. The speed limit on a given road does not make allowances for any kind of maneuvering - the idea being that if you had to increase your speed to 5 kph over the limit in order to pass, then you didn't need to pass. Additionally, all speedometers on cars and bikes are supposed to read fast. True, they have a known inaccuracy, but they are required to err on the side of overestimating your speed for PRECISELY this reason.

Where did the OP receive this ticket?

I never intended for this to be a court type argument but I feel that to get a ticket for 5 over is a bit unreasonable, putting the law aside.

"Reasonable" in itself varies from one person to another, and IMHO I suggest the OP to challenge it and hope the officer doesn't show or the prosecutor to drop it.

Actually, it isn't BS. I said "additional issues." The ones, that you stated, were already implicitly stated up-thread.
 
What trouble? 1 over, 5 over, 15 over, 40 over, it's all the same, with the only difference being the fine. Insurance companies see those as "minor convictions." Major ones are in the 45+ range (depending on the insurance company), careless driving, stunting, drunk driving, school bus... Demerit points don't matter to most drivers. Unless your job demands a clean abstract or a conviction would get you in the 9+ range, they can go **** themselves with the demerit point system.

He said he clocked me at 80 something (which is 20+ over limit) but I honestly think he's just saying that to make himself sound like a nice cop and convince me to pay off the ticket. I just cant see how I can accelerate to 80 something from the distance where he clocked me since I was accelerating slower than an SUV beside me (which I asked why he didn't pull him over as well and he said I was accelerating faster than the SUV was and thats BS because that SUV was 2 car lengths ahead of me but its just more convenient for him to pull me over since I was on the inside lane).

So the thread title is totally misleading. You didn't "get booked" for doing 5-over. You were doing much more than that. You simply lucked out and got a much-reduced ticket for only 5-over, and now you're complaining about it? :rolleyes:

Then you should have mentioned that in your original post. It might have resulted in some markedly different advice. You were stopped for 20-something over. You received a ticket for 5 over. At trial that 5 over could once again become 20-something over.
 
since 5 over is treated the same as 20 over, even if they revert a reduced ticket, the indicated speed on the ticket is irrelevant. You may pay a bigger fine (maybe?), but for the couple extra $ compared to the insurance increase from potentially losing preferential treatment makes it worth fighting. Its the fact it will be a conviction, not what the speed is.
 
when I got my second ticket (with statefarm). It didn't go up $40 it went from 2000 to 4000 a year (p.s. this was with my car when I first started driving.)


Always fight your tickets, no matter what. You lose a days pay but your not paying 2000 extra a year for insurance.
 
Fight it. Judge will dismiss it in 5sec and ask the cop why he's wasting everyone's time

This is on Steeles & 404 going East bound. The cops were hiding in the bus shelter w/ a radar just right outside where you turn into the Goodlife Fitness building.
Beware!

The traffic is fast on that section of Steeles, between Woodbine and Vic Park. Almost no driveways on either side. It is an ideal place to get run over if you're on a bicycle, ebike or small scooter. On a positive note, Sayal Electronics is just south of there on Vic Park.

Call them, see what they can do, if they can help you, you're better off paying them to fight it for you, than risk insurance rates going up for the next 1-3 years.

Another false assertion.

The "R" is an optional indicator. It doesn't need to be there even if the speed was reduced. Also, the speed noted on the ticket is not evidence. The amount on the ticket is merely an out of court settlement offer.

If you choose to go to trial, you are effectively turning down the out of court settlement offer. The trial can then bring in the actual speed you were clocked doing. The evidence of actual speed clocked will be in the cop's notebook, and the contents in that notebook can be called in as evidence at trial.
 
Fight it. I got my first ticket for 22 over and not having an up to date slip. Paid Points 350$, didn't loose a days pay and still have no tickets.
