Got booked for 5 km/h over!

Yes, I'm frustrated. I just don't know why they even bother.

Anyways, the ticket is only $25 and no points off. The cop suggested that I just pay it off and save the trouble.
Just wanna know if I pay off the ticket, will it effect my insurance even tho its only 5km over with no points?

My work schedule is crazy and I just don't have time to fight it in court.
What do you guys think?

Thanks!!

A minor ticket is a minor ticket. 5 km/h over or 49 over (or 45 over depending on insurer) are the same. You've been around long enough to know most insurance companies forgive one, surcharge 10% on subsequent tickets. Statefarm can get ugly much faster as you can get dropped from the preferred rates category.

How did you get so unlucky as to get 5 over? Was that reduced to 5 over, was there a blitz or was the cop just bored?

Sorry to hear that, OP. Yes, it will affect your insurance record the same as a 40 over ticket (personal experience), so fight it. Google ticketcombat as it has an excellent primer on that. Also check out our laws/regs forum since there is good info in there as long as you ignore the "ha ha, you deserve it, you are guilty, pay up" idiots who post crap without contributing anything useful.

It can be a blitz in an area where a blitz is not needed. If the traffic is light enough, they'll nail you for b.s. like that. Happened to me in Sudbury a few years ago. The time and place of the speed trap indicated that he was hunting for out of town students and the court dates would have fallen during their summer breaks when they're hundreds or thousands of kilometers away. Since it was on a Tuesday night, traffic was non-existent so, he was nailing people for all he could. 5+ in my case. Wasn't reduced from anything and it's even questionable whether I was going over the limit.

omg...hahahaha...are you kidding...wow, maybe if you have a bored friend, they can go as your agent...but yeah, if it's your only ticket, it will most likely go unoticed, but if you get a second ticket, you could be looking at $40 extra a month insurance for 3 years, and then at that point, it might not go down much anyways after 3 years...so fight it if you can...where the heck were you that the police officer decided to nab you for 5km over?...like seriously, if i were a cop and i was told to give these sort of tickets out, i wouldn't bother, what a waste of tax payer time...

Some may forgive one ticket while others have a "conviction-free discount". Really depends.. In any case, it will be on your record for 3 years from the day you get convicted (paying = getting convicted).

I recently got the same ticket. Only difference is, I was actually doing 80 in a 60 zone. Cop pulled me over and gave me two tickets...
1) speeding 5 over the limit instead of 20 over
2) failing to provide a valid insurance slip (the date on the slip was valid, he was just too lazy to take it out and actually LOOK at the date)
Anyways, fighting both tickets (obviously) and I'm pretty sure I'll get the both tossed.

OP, it's worth it to fight the ticket... Don't think because there is no points and it's a small fine that it will go unnoticed. If you are convicted it will show on your driver's abstract, which is looked at by all insurance companies.

Good Luck!

was this a reduced fine? or were you clocked/paced going +5km/h over

if it's reduced they can return the fine up to the original if you plead not-guilty. i would definitely request disclosure and start preparing a defence.

where's Mr TurboNiceCatchDish?

if you got dinged literally for 5k over and it wasn't reduced down from something like 20k+ over then fight it on your own

walk over to the Crown and simply say "WTF??? did you do the limit down to the exact kph on your way here today?"

5k over tickets would be a nice trend to see being fought in court.....it's the ultimate waste of everyone's time and money....aka - the guy that wrote the ticket is expendable

Take it to court, I highly doubt he will show up for a $25 dollar 5 KM over ticket and embarrass himself in front of the judge over it wasting everyone's time. I don't even think that he will submit that ticket. Too many reasons for the bike to go over by 5 KMS, a lane change would do it. Even digital odometer has a +/- 2 for accuracy. So for 3 KMS over which is barely noticeable you can get clocked and ticketed. This is completely unreasonable.

If it was reduced from a then pay it. were there any other tickets or just the one?

Had one of those a long time ago.
Cop was stopped at a light, and I went through as it turned green.
When he stopped me he said that I must have been speeding by the way I passed him.
We had the sunroof open and were having a good time cruising along at the limit, timing the lights, playing some edgy music that my brother-in-law gave us.

Come trial time, he was the only officer to show up. Got on the stand and proceeded to say that he followed me at a constant velocity and clocked me on his speedometer. I was flabbergasted into speechlessness. I still remember his name to this day. It took me a long long long time before I trusted the police in general again.

A few years later it was off my record and I didn't have to worry about it.
I don't get pulled over that often that I need to fight tickets, unlike some others here who will tell you to fight every ticket, hoping that you can help delay their trial.

I just wanted to point out that these are not valid arguments. The speed limit on a given road does not make allowances for any kind of maneuvering - the idea being that if you had to increase your speed to 5 kph over the limit in order to pass, then you didn't need to pass. Additionally, all speedometers on cars and bikes are supposed to read fast. True, they have a known inaccuracy, but they are required to err on the side of overestimating your speed for PRECISELY this reason.

Where did the OP receive this ticket?

A ticket stays on your record for 3 years from the conviction date.

Not all insurance companies pull your record every year so you may be lucky and get a year or two with no increase, however if you try and change insurers you will be charged for that ticket. The conviction free discount varies, but some companies it can be as much as 15%. So the $25 ticket is not a $25 ticket after all, even if you get dinged by your insurer for only one year.

I would still fight it if i were you since it's your first one. Having a spotless driving record is essential to keep your insurance rate down. A minor speeding ticket would still be a speeding ticket in the eyes of most insurance companies.

Were you riding alone when you were caught? is this a reduced ticket??

Fight it. You'll help yourself and help everyone else. The Justice system is extremely clogged...have had 2 tickets automatically dropped after pleading not guilty.

Yes, cop told me it was reduced. But I was accelerating from a complete stop making a right and can almost swear I wasnt going more than 75 (60 zone) by the time I got there because even cars are driving faster than I was on the outside lanes.

Sounds like some of you are saying that if its a reduced fine, I should pay it off to avoid trouble?
