I don't think anyone in their right mind would sign something like that.


Right and not only that but fault determination and stuff is assigned by insurance. So it would have no bareing on anything not to mention it could probably be argued it was signed under dures. You would be a fool to sign it.

Anyway you cant blood from a stone who knows what the other parties financial situation is
 
Is there anyway you could draft a simple document - one that the other driver can sign, the OP sign's, with the date and a witness to state that; "the other driver will be financially responsible for any and ALL damages to the OP's motorcycle, gear and any additional hospital bills for up to 12 months"

Would something like that hold-up in civil court? I think it would...

The other driver would have to be completely brain dead to sign something like that Would you sign a document that put you personally on the hooks for many thousands of dollars?

I would suspect that if you got them to sign it immediately after the crash, they would be able to argue duress or not being given time to properly review or something like that. If they sign it later, they are stupid and I doubt they would follow through without a lawsuit.
 
Small update.. I called insurance and filed the claim.they said 24-48 hours to get some adjuster to review my claim and all that. Guess I have to wait. Ill give them a call to ask bout towing billing insurance directly to take it from the police lot to the dealer for a proper appraisal.

Don't be surprised if you need to cover the storage fees yourself and have the adjuster tell you they'll reimburse you
 
i had my bike knocked down 2x while parked. Both of them agreed to pay for damage when it happened. When I got the quote for just parts to be replaced and I do all the labor, they think its too expensive and need to go thru insurance. both times the quote came to about 2500 for just parts and that doesnt include scratched stuff.

You might want to check with who ever you plan to use to give you and estimate and/or repair the bike. Most likely they'll pick up your bike themselves and not charge you for it.
 
None sense they'll only pay for couple of days storage..kneedragger88 I pmed you..let me know if there's a # I can contact you at.
 
Why would this guy pay for anything himself......his insurance will know about the accident and its on his record.
 
It's funny how they change their tune once the bill shows up, let insurance handle it.

That's what happened in my case where a woman backed into the Busa, knocking it over pretty hard onto it's side.

She tells me she's already got two collisions on her record, and will lose her license if she gets a third and emphatically offers to pay for all the damage.

I tell her there are 4 fairings cracked/rashed, likely costing at least $2000, not including bent levers, shattered windscreen, labour, etc.

She looks stunned. Her response: "Well I can't afford that! Can you help me out???"

The repair quote (done by Heritage Auto) came out to just under $6000 IIRC. Insurance wanted to write it off, but I "bought it back" (they gave me a payout minus the estimated salvage value which was about $1200) and repaired it myself. Whole process took 4 months of haggling with the insurance company (Primmum) which wanted to bend me over backwards (they wanted all repairs completed within 2 weeks of cutting me a cheque, and the bike safetied -- even though all the damage was cosmetic -- before they would re-insure it, otherwise they'd drop me as a customer and send me to Facility insurance)
