Driving quiz for you.

You come to a four-way stop sign intersection.

It's your turn to go.

A pedestrian is waiting to cross in front of you.

Do you go or give the pedestrian the right-of-way?
 
I pop a wheelie and give them the finger as I go by :cool:.

Seriously though, I usually always give pedestrians right of way.

What does the law say? Anyone know the Highway Traffic Act on this? Reason being, I saw someone wave to a pedestrian to proceed. The pedestrian walked out and this girl in her car (on a cell phone) to the right bolted out into the intersection and plowed the man over. So it was the riders turn to go, he gave the man walking the right- of-way to cross, the man starts walking, woman on cell bolts out into the intersection and plows the man throwing him over the hood and roof. Brutal and bizarre. And she kept on going! Got me wondering, is the rider at fault for indicating to the pedestrian that he saw him and gave him the right-of-way?

1* Pedestrians always have the right of way, unless there is a traffic signal to stop them. If there is a 3 hour parade of pedestrians crossing your path then you have to wait 3 hours.
2* Even when they don't have the right of way, it's not OK to run them over.
3* Giving someone the signal to proceed does not make you responsible for their choice to do so.
 
Wow, sorry you had to witness that. I hope the guy is alright and they catch the driver. Another example of a stupid cager on a cell phone.

I'm not 100% on what the HTA says. I'm sure one of the forum legal experts has the answer for you. I just wave them through more out of common courtesy. Usually in an accident involving a vehicle and pedestrian, the onus is on the driver to prove absence of fault. I believe the HTA does state somewhere about pedestrians having the right of way at crosswalks. I think the definition of crosswalks might differ depending on individual city bylaws. It could be clearly designated crosswalks or simply an implied crosswalk defined as a sidewalk meeting a road and then a sidewalk on the other side. Again, I'm sure someone will chime in with a more definitive answer for you.

Lol, I was thinking the same thing reading the responses.
 
Pedestrians always have the right of way, regardless if they're jay walking or whatever. Hell, I haven't heard of any j-walking issues since high school..or even tickets being handed out. I just remember my high school teacher telling me way back that if you ever hit somebody, even if they're trying to commit suicide, you'll end up at fault somehow.

Now if you DON'T hit them maybe you can call the cops to get them into doo doo?

Pedestrians do not ALWAYS have the right of way if they are jaywalking or whatever. That said, if it can be proven that you could have avoided them, you'll probably get charged with something.

From the original question, obviously the pedestrian has the right of way to cross. However, if it appears that they are not going to cross or that I could cross before them without scaring the **** out of them, I would probably go.
 
There's plenty of stories of pedestrians getting hit and then the words 'no charges pending against the driver' being also included at the end of the story.

In the end the onus is on the driver to try and avoid the collision, but if a pedestrian runs out in front of you without any warning there's not much you can. We've seen an increase in pedestrian hits/fatalities recently and from what I've been reading it's typically the pedestrian that doesn't look both ways (or at all!) before crossing...there's a sense of entitlement that the car will stop because I am the pedestrian...sorry but no. Like it's been said before on this forum, and many others...there needs to be stiffer penalties for pedestrians and way more education.

To answer the OPs question, I always wave the pedestrian through. It's just safer in my opinion instead of me starting to drive and them thinking that I'll let them by regardless and cross.

It's okay to hit pedestrians if they are j-walking? lol
