CBSA and radar detectors

I am well aware that radar detectors are illegal to even carry in Ontario. I still want to get one for my US trips. I am not to worried about police searching me for one, but I am worried about CBSA. Will CBSA agents confiscate a radar detector?

This outlines it pretty well:

http://radarscam.com/Section 79 Speed measuring warning devices.pdf

(2) No person shall drive on a highway a motor vehicle that is equipped
with or that carries or contains a speed measuring warning device. 1996, c. 33,
s. 12.

This travel guide states:
http://travel.state.gov/travel/cis_pa_tw/cis/cis_1082.html

It is illegal to take automobile radar detectors into Quebec, Ontario, Manitoba, the Yukon or the Northwest Territories, regardless of whether they are used or not. Police there may confiscate radar detectors, operational or not, and impose substantial fines.

I cant find a law other than HTA that bans radar detectors. I can't see how CSBA would confiscate it, unless they can enforce HTA.

Interesting question, the CBSA would technically not have the jurisdiction to seize it from you, BUT could easily alert OPP and have them waiting for you as federal law has nothing to say about them. You could always just not keep it in plain sight and hope they don't search you. Or alternatively you could enter a province where they're legal.

Are you trying to get it shipped to your door or do you already posses the item and worried about crossing the boarder back to Canada.

just out of curiosity... what is the fine for carrying it and is there a different one for using it?

fyi - costco sells them out of province. if you really want one have someone else buy it and ship it to you within canada, then there are no borders for it to cross.

Forfeiture of device
(4) Where a person is convicted of an offence under this section, any
device seized under subsection (3) by means of which the offence was committed
is forfeited to the Crown. R.S.O. 1990, c. H.8, s. 79 (4).
Penalty
(5) Every person who contravenes subsection (2) is guilty of an offence
and on conviction is liable to a fine of not less than $100 and not more than
$1,000. R.S.O. 1990, c. H.8, s. 79 (5).

No same thing.

I bought it on ebay and I shipped it somewhere in Niagara. However I do plan on crossing the border with it a few times year to go on the VT and NY roads.

so... doesnt affect driving record or insurance rates? seems worthwhile lol

Buy a cheap used $20 unit also.

I'm not sure how many times mine saved me. One of the best devices that i've used.

Beltonics STi Driver is the way to go.......undetectable.
Same with Velentine 1.

I believe the charge is 3 points and $110

It is not illegal to own a RD. It is illegal to operate one.

CBSA cant say jackshit to you about, but could mention to you it is illegal in operating them in Ontario.

You also wont be able to order one from the US, and have it shipped here.
( unless theyve changed the rules)

There's lots of places in Canada you can order online and they'll ship it to you here. If you need something send me a PM and I'll give ya the link(s).

They sell laser jammers too, work SWEET! Gives you just enough time to slow down then lets it lock on ya.

Does that work with SD cards from your camera? Even if they see you take it out and put it in your pocket?

Lots of places sell them in Canada. You can buy them off the shelf at Future Shop in provinces where they are legal, so they arent difficult to get up here. At least some of the Beltronics are made in Canada.

It's a HTA offense so I believe it does.
well thats the only thing that would stop me from wanting one.
i could care less about a $1-300 fine, or whatever... its being pinned to my driving record and affecting insurance that makes it not worth it.

can cops really take your SD card as evidence if they want to use it against you for speeding?

In my non-criminal HTA court case I questioned why the cop was able to remove the SD card from the camera on my bike and review it. The judge said that it's part of their investigative tools, to examine anything in "plain sight", and my camera was in "plain sight".

The answer didn't sit very well with me. He had to remove the camera from the mount, unlock the battery door and remove the SD card. That's not really what I call plain sight. That'd be like me having my SD card in my trunk and he had to unlock and remove my cowl cover to go in there and get it.
