Canada Post / USPS damaged a package

I'm seeking for someone who might've had similar experience and could give an advise.
I shipped a motorcycle gas tank via Canada Post Expedited Parcel USA. The tank arrived damaged (scratched). I have pictures of the tank (I took during packaging) show that the tank was completely wrapped in bubble wrap and the box was filled with packaging material to prevent any movement inside the box. The damage appears to have passed through the box and through the layer of bubble wrap and caused a deep grooved scratch in the tank. The shipping alone cost over $100 + the package was insured for $600. I contacted Canada Post and open a service ticket.
My question is what amount of $$$ (if any) should I expect in compensation and how long it may take? The tank is still usable, but the scratch is on the top of the tank (near a filler cap) and is very visible. Probably, the only way to fix it is to repaint the tank completely. The tank was in "like new" condition, so I understand why the buyer got upset. It's not my fault and I'm not going to refund the payment, but I'm going to assist the buyer with resolving the issue as much as I can. I'm just curious (not that I think it'll happen!), is it possible that PayPal withdraw money from my account just on buyer's request without proper investigation?
 
Paypal usually always sides with the buyer if they open a complaint . You will most likely need to refund them in full and get w.e you can from Canada post.

But they go look at how you try and make it correct. you might possibly be able to work something out with the buyer. like a partial refund that would cover the cost of the repair PP really don't like to get involved and it takes ages for them to do anything in allot of cases. Just make sure that you submit all your pictures of pre-package a get the seller to submit yours for your insurance claim
 
If the buyer opens a dispute with PayPal, you (the seller) will get a chance to provide an explanation (you will get an email from PayPal that you must reply by certain date). PayPal will not take money from your account just because.

In the other topic... I just hate Canada Post (sorry to all the employees, nothing personal, but the organization sucks more and more everyday).

Im assuming the buyer paid for the shipping and insurance, what do you mean you wont refund the money?

I mean, I'm not going to pay out of my pocket. Sure, all money (if any) returned by Canada Post goes straight to the buyer.
Thanks everyone for the replies. I'm not too concerned about PayPal, the buyer seems to be a good guy and understands that it's not my fault. I'm interested in hearing from people who had to file a similar claim against Canada Post in the past and how it was resolved.

They get the tank and pay you the insured amount. What kind of fuel tank is it?

How technically does it work? The tank is in California right now. Do they pick up the tank and give money at the spot, or how? I won't give them the tank until I have money in hands.
 
As far as the buyer is concerned my understanding is that PayPal has their back, not yours. Buyers expect to receive the item in the condition you listed it and they too were not responsible for the damage. Unless you can work something out with them my guess is they will be told by PayPal to ship it back to you and the sale will be cancelled.

As a buyer I probably wouldn't want the tank ever if you agreed to cover the cost to repair it (using the insurance you bought) but perhaps that's just me.

So, you're saying that I'm responsible that the post ruined the tank? Nice try! I have tons of pictures to prove that the tank was properly packaged. As I see it, my responsibility is to assist the buyer with getting postage and insurance money back, and not to pay for someone's mistake.

If been in this situation as the buyer. Pay all refunded me the money against the seller. Seller needs to deal with Canada post.
I paid for an ideal in said condition, if I don't get thath , u don't get paid.
 
Agreed. Canada post 'lost' and ecu I was shipping expedited 4days to US. The package somehow ended up to it's destination with no scans so Canada post kept calling me about the open claim thinking my package still hadn't been deleivered.
 
Tough call. I'd say you did everything right and as long as you can prove it then Canada Post should refund any money owing. Not sure how it works with paypal but judging from the comments above you may be SOL.
 
I was raped by both Canada Post and Paypal
Many years ago I sold a set of built forks. Was paid $800 via Paypal, A week later the buyer emails and says theu are bent. What? I tell him the forks are as raced last at Daytona and they certainly were not bent. He tells me took them to his shop to service and they told him there was 0.002 runout. I tell him he is nuts. I suggested that first I would question HOW they measured it and also does he know thats half the thickness of a piece of paper? I find out that they clamped the fork in a vice and measured at end of tube. At this point I tell him to send them back and I will refund him (only because I am tired of dealing with an idiot). He refuses until I pay him the 180 that his shop charged him to tell him they were bent while trying to sell him/me a new slider for $300. Anyway lovely Paypal locked down my account (over $3K) while they investigated. Took two weeks to the day they come back and say they need a secondary investigation (another two weeks too the day. I called Paypal and suggested that they at least release the money not in dispute. Nope cant do that. Then a month after clain started I get an email saying that after investigating they rule I am at fault. WTF! Anyway buyer told to return the forks and they will refund his money. After all that he refused saying he was using the forks. I have not used Paypal since.

Three years ago I had to send my timing system controller to Seattle for software upgrades. Insured it for 5K. I get the invoice from the manufacturer on it there are notes saying damaged due to operator abuse, recieved damaged ....... I get the unit back (its basically a touch screen PC) sure enough the case is all busted on corner . Its functional but busted. I put in a claim. They call and are going to send theyre adjuster to look at it. No prob. Then a week later they tell me that I have to give it to them so they can send to theyre facility to see if it can be repaired. i tell them that first I need it for upcoming events and second its a sealed unit that contains proprietary software that if tampered with I lose my warranty. I am not giving them the unit. It needed a new PC then have manufacturer swap over the software. Likely be under 2 grand to fix but MUST be done at the manufacturer. Basically I got NOTHING and it still sits at my shop busted.

A close friend I work with here at work has a story just like Ken's only it was with a laptop shipped to Greece.

The buyer claimed it was broken when it got there, (it most likely was not) .. only what happened was the buyer filed a dispute, and got the money refunded, and then did not ship the laptop back. He just kept it, the same way as the forks.

Best of luck to you OP, I hope the buyer is a person with a reputable user id on some forum you're both a member of, and doesn't want to tarnish his reputation.
 
Thanks for the stories, Ken. I'm sorry for your bad experiences :(. Now I see why more and more sellers refuse to accept PayPal as a method of payment for any valuable items...
 
Hi! I haven't used PayPal with my customers but do ship very often. Since the tank was insured for $600 a case file will be opened and someone form Canada Post will come out and inspect the damage which is being claimed. Make sure to have your customer call Canada Post right away, unless you paid for the shipping on your account. Whom ever paid the shipping needs to contact Canada Post so the file can be placed onto their account. Once someone comes to see the damaged goods or reviews the pictures a cash settlement will be notified to the correct party who paid for the shipping. I'd doubt a full $600 will be given but a settlement will be paid in order to cover the damages so maybe $150-$250? Can't promise you'll get this amount but I can only go by my experiences with using a freight company. Oh! If all else fails call customer service and express the damages and be polite and you'll get this dealt with in a timely manner. With Purolator I can usually get a settlement done within 4-7 business days.

Thats not what happened with me. They said they were sending someone but never did. They wanted me to ship it to their facility. I have since shared my story with quite a few people. Yet to meet ANYONE who has actually received compensation. Maybe just the people that I know but please if anyone actually got something please share.
