Cam Seized by Outaouais Police

Interested to see how this one pans out as well, but watching both the CTV video and the one posted on the police department's fb page, I'm not overly impressed at the clip they posted. Yes, I guess passing on the yellow is illegal there, and yes they were speeding, but I thought it would be more like the 300km/h BC lanesplitter.

Not saying I condone breaking laws, but if the whole video is like the clip, to me it seems some cars were ****** at getting passed illegally on a road with no passing lane, and decided to complain to the cops, potentially because it was a motorcycle vs a civic that did it. I also find it hard to believe police have the right to stop and seize a camera or memory card based on calls -- Sure if they radar'ed the pair at 200km/h, chase ensued, and when pulled over they seized it I can see, but not a "so you match the description of a biker someone complained about, now hand over your footage" situation. If that's legal, then what's next -- You match someone's description for something so hand over your cell or point-and-shoot camera and we'll charge you with anything we don't like on it? lol

Well the passes that were shown were unnecessarily close or even same-lane. In Ontario that would be HTA 172 territory.

200 in a 70.....yes really.

Darwinism at it's finest.

I know of perfectly straight roads out in the country with no houses with limits of 60. I'm sure many people rip it down them occasionally to test out their toys. It's not a big deal. Worst case they might hit a deer.

In many states the cops do search your phone...
 
It sounds like the only creditable witness is the camera. Are the police legally allowed to seize it and use it against the owner without a court order in hand. PQ laws are different than the rest of Canada in many respects.

Stupid antics regardless.

The crown will no doubt argue that the video camera and ensuing video were seized as the offender made an attempt to "conceal the evidence". (which in and of itself could be a separate criminal charge). Note in the article that the police stated that the rider was observed trying to conceal a video camera. This would give the police reasonable and probable grounds to conduct a search and seize the evidence. Forget for a moment it is a video camera a police office stops you for a traffic violation and he sees you attempting to conceal something in your pocket, so he gets you out of car and does a search, (he has no idea what you were concealing it could be a weapon etc), then he finds some weed. He can now seize the evidence and charge you with the offence.

Not sure where you got your info to the poster who stated the "most they could get is 7 demerit points upon conviction, and that were only if one of the charges was for failing to stop for police" This is not at all the case EACH conviction has it's own demerit points assigned to it, and just like Ontario if your convicted the demerit points are assigned by the transport ministry to your driving record. Now having said that the police have PURPOSELY overcharged for 2 reasons.

1. to send a clear message to all riders that this type of behavior will be dealt with swiftly and harshly.
2. to ensure a conviction, any lawyer is going to advise his/her client with the video evidence to accept a plea deal, (the crown will likely choose 2 - 3 of the more serious but not the ones with the most substantial penalties), for them to plead out to. This will likely carry enough demerit points to ensure they are not riding for a period of time

A lot of punishment for not hurting anyone. Could have happened, sure... but I know I am not alone in saying that I've experienced more spirited rides.

Let me guess; "improper turn" for turning left across the rider's path, right? That's what the unlicensed and uninsured pizza delivery guy who wrote off my Bandit 1200 got, though he was also ultimately hit with $6K for driving without insurance.

And the guy who did that to me wasn't even charged. The cop said there were no skid marks my lane to prove I didn't hit him (no time to do anything but tilt to a 1 degree angle). Although his car was at an angle across my lane, all the debris was in my lane. My bike which flew over his car was in my lane, and I was about a block further down the road in a straight line still in my lane. The QEW was directly to my left separated by a cement barrier.

But he said I probably hit him.

So be thankful you at least got the charge.

This is why I have my camera. Not to record any crap I may get up to....but to record day to day rides in the event some cock decides to do a left turn right in front of me, or like the braindead woman yesterday...merges into my lane with me already there. I continually wipe the memory card and reuse.

Having the camera has enabled me to catch a couple of things though...like the car that wiped out in front of me on the 401 and the car who's hood was loose and blew over the windshield at 120kmh in the fast lane on the 417 in Ottawa.

It was a little hard for anyone to say that it had happened otherwise given that my bike's front wheel was embedded in the bumper and the headlight was flush with the top of his hood. Best stoppie I've ever done.

If you have rode a liter bike and have taken up the speed mentioned here, you would know it doesn't take long to reach 200kph.

Last time I rode a 2013 CBR1000R at 204kph in a 80 zone believe it or not, it was just that easy.

Forgive the couple, there were just having some fun.

But I agree they need to be responsible for their action.

eff that.

100 in an 70 I can understand. Hell, 120 in a 70 I can understand.
200? That's beyond irresponsible.
