If you are in this lady's shoes, the right thing to do is say sorry for hitting the bike followed by "get a quote for the damage, I will pay 100% of the cost to have your bike fixed to the condition it was in as soon as possible". If she was to say something like that, the gesture alone shows that she is accepting full responsibility, wants to make it right and is sorry for inconveniencing you.

That is what I would do if I was her so that is what I would want in return if it was my bike.

If she starts giving you a hard time about the $ amount, then I think its fair to say that she might not of left a note there if she continued to reverse and crushed your bike in a major way.

I'd attack this from every angle to ensure my bike gets fixed and my insurance doesn't get touched.

Just a quick point of interest - In Ontario you always go thru your own insurance. Regardless of who is at fault you call YOUR insurance company and they pay your claim. If you are not at fault your insurance company pays the claim but your rates are not affected.
 
Fragile little things these supersports.
I guess the issue for the lady would be how much damage was already on the bike.
This type of situation always has that issue because, some riders would try and milk it, so that the bike might as well be written off.
The best response to "let's not go through insurance", might be "Isn't that what insurance is for?".
 
Hey all,

about to head home on my bike last night but unfortuntley as i walked up i noticed my broken mirror and foot peg sitting on my seat.

There was a note taped to the bike from a lady explaining she accidently hit the bike while parking and that i should call her.

The phone call went fairly well she doesn't want to go through insurance and says she'll gladly pay for the foot peg and mirror but i tried to explain that theres more damage to the bike then just those 2 obvious things. fairings are scratched front to back with a couple cracks bar end broken etc,

so my questions are

if she decides to play hard ball and ignore me since i want more then $100 (thats what she thinks it costs to fix the footpeg and mirror) should i just go through insurance?

If i do go through insurance does my insurance pay for it? or does hers?

also the only info i have is her note with signature and phone number. if i wanted to report the incident is this enough info to give them? because i highly doubt if i call her and ask her for all her driver information shes going to give it to me.


any help / advise is greatly appreciated.

I would ask to meet up with her and then write down her license plate if she doesn't want to pay up. Record your phone call and and you have the signed paper all things you can give to the insurance company.
 
Get three quotes quickly and provide to her. She won't believe more than 100-200 dollars would be possible. She'll refuse more than likely. I said get it quickly cuz when she denies, you'll want to put in a claim...

You'll need her information as well cuz if you report it to your insurance, it'll automatically be comprehensive. She can easily say she didn't do it if you try to go after her. You need a report to document she did it.
 
I have been thru something similar ... it was just a dent on a vehicle, since it wasn't something that I was terribly worried about I thought I could fix it for $400... and told her that .. I wasn't trying to rip off the person, they offered me $100 ... and I reiterated the PARTS COST would be $400 and I'm doing the work myself to fix it so no labor cost to her. She refused to budge BUT she said that she would pay the repair cost at her regular garage ... I said fine, she met me down there and she signed a blank invoice with her 'friend' ... I left the vehicle picked it back up 2 days later ... I asked the guy at the shop how much was it ? $1200 bucks ... of which $350 was parts cost ... hahaha !!!!
 
Call your broker right away, be sure to state you are NOT making a claim, however inquiring. They will answer your questions.

Basically what you need to know IMMEDIATELY is if you need to report this through police, as it's technically a hit and run, or a collision centre, since she left her info. You have up to a year to make a claim, but only 24/48 hours from an incident to report it. And just because you report it, does not mean you HAVE to make a claim. Find out from the brokers where your leverage points are with this lady ie. can you report it as a hit and run if she refuses to provide you with insurance information, will this count against you if she does etc etc.

Go from there...

From the CAA website I found the following:

The Highway Traffic Act of Ontario indicates that you must report any accident that involves an injury, and must report any accident in which the total damages to all vehicles and property is greater than $1000. You must notify us within 7 days after the accident, or if unable, as soon as possible after that.

I'd quickly get a quote, visit the lady and get a firm yes/no that she is or isn't going to cover the full cost. She apparently wants to do the right thing but is underestimating what the cost to fix it is. If not, see if you can get her insurance information and go through your insurance. The note and info (along with your conversations) should be good to cover you. Based on the above you have 7 days to report it. Given you weren't there when it happened you shouldn't get any grief.

been a while since i had an accident, it was not my fault either, and the other driver was charged.. but what happened then was my insurance company paid for my repairs, but the other drivers insurance company had to pay my deductible. that was in 99/00

Ya things have changed since then. I really doesn't matter what happened, your company pays your claim and the other person's company pays theirs.

Some companies will let you call in give the details and then decide if you want to put thru the claim. Some will list a claim on first contact. But OP shouldn't be too concerned with that because as long as there is a CRC showing that the accident was A) involving another vehicle while OPs bike was parked and unattended or B) shows that it was a hit and run it will not affect the premium in the future.

ONLY at fault accidents affect your premium and this is a DCPD claim at best and a not at fault collision claim at worse. You'll be fine!

The motorcycle was parked when it was hit, so the insurance company will not assign fault to the OP. If fault is not assigned, the OP's rates are not affected. The OP has nothing at all to lose by reporting the incident to his or her broker and getting it on record.
 
hey man... this happened to me 2 months ago... i would do it through insurance trust me... they cover it, and youre payments wont go up, atleast they did for me .... she will give you 500 dollars when in total it might cost around a grand .... so lets teh insurance handle it
