bike knocked over - advise? - yellow 600rr

Hey all,

about to head home on my bike last night but unfortuntley as i walked up i noticed my broken mirror and foot peg sitting on my seat.

There was a note taped to the bike from a lady explaining she accidently hit the bike while parking and that i should call her.

The phone call went fairly well she doesn't want to go through insurance and says she'll gladly pay for the foot peg and mirror but i tried to explain that theres more damage to the bike then just those 2 obvious things. fairings are scratched front to back with a couple cracks bar end broken etc,

so my questions are

if she decides to play hard ball and ignore me since i want more then $100 (thats what she thinks it costs to fix the footpeg and mirror) should i just go through insurance?

If i do go through insurance does my insurance pay for it? or does hers?

also the only info i have is her note with signature and phone number. if i wanted to report the incident is this enough info to give them? because i highly doubt if i call her and ask her for all her driver information shes going to give it to me.


any help / advise is greatly appreciated.

I would get a quote and give it to her. If she says she won't pay, inform her you are going to insurance and they will be getting a photocopy of the paper she left you. I am sure they have ways to tracking the phone number down even if she cancels it, there will be a record. Then follow thru if she still won't pay.
 
Be pleasant and meet with her. When you do hope she will be using a vehicle and jogged the the vehicle marker. If the note just has her signature and phone number it means nothing. Even if it did have further details on the paper it will become a civil matter. You have 48 hours to report it to a CRC.
 
Call your broker right away, be sure to state you are NOT making a claim, however inquiring. They will answer your questions.

Basically what you need to know IMMEDIATELY is if you need to report this through police, as it's technically a hit and run, or a collision centre, since she left her info. You have up to a year to make a claim, but only 24/48 hours from an incident to report it. And just because you report it, does not mean you HAVE to make a claim. Find out from the brokers where your leverage points are with this lady ie. can you report it as a hit and run if she refuses to provide you with insurance information, will this count against you if she does etc etc.

Go from there...

I admire her wanting to do the right thing. But, it seems she did so expecting it would cost her $100 not the $1-2k that's more likely (I have no idea what your parts cost but complete plastic for one side of my bike would be well over $1k).

You do have the name and number of someone that left the scene of a traffic accident that they didn't report to police. At anytime that she balks you can involve the police on this (although they may choose to do nothing).

I'd be talking with my insurance agent for advice on how to proceed.
 
Wow that sucks, but you did kind of get lucky that she left a note. My girlfriend's R6 got knocked over in Toronto and theres a huge dent in her gas tank now. I don't see why this would increase your insurance, it has absolutely nothing to do with your bike or your riding; it's just the stupidity of a driver hitting a parked vehicle (could have been anything and therefore completely accidental).

Although it probably won't be usable in any kind of legal situation I'd start recording conversations with her as well and hope you can catch her admitting fault. If you weren't there and there are no witnesses it could be hard dealing with insurance if she decides to become a b***h about it as most people do in my experience once they find out the actual costs.

So I've been reading the forums for a long time now and got TONS of usfull info from all of you guys, so first off a big thanks. Now, I'm an insurance adjuster so I thought that I'd try to help out a little bit about a topic I know a little bit about. First things first, the ball is in your court....if you want to give her a chance to pay the full amount of damage you can. If not then go to a CRC and report it. The police will call her and tell her she has to come in and report as well. Give them what info you have about the other person (you can also try calling them and asking for it as they are legally obligated to give it to you.) another option is to reverse search the tel# and find her address, go for a drive and get her plate#. You can then call your insurer and report the claim.
With the plate# your adjuster can find all the info they need.
Your adjuster will call the other person's insurance company and as long as they can confirm the details of the accident with them your deductible will be waived and your rates will not be impacted

Now, the worst case scenario. If for whatever reason your insurer tells you that they don't have enough evidence to rate the other person 100% AF you will have the option of going with a hit and run claim. You pay your collision deductible and your bike is fixed. You're till not AF becuase your bike was parked and unoccupied so your rates are NOT impacted however your insurer will require a police report stating that it was a hit and run.

Sorry it's kinda wordy, it's just at this stage you can take it a few different directions.

I would report this to the CRC/Police regardless. I have little faith in people, especially on matters like this.

If this lady decides that all she wants to give you is $100 and you've wasted your chance to report this then you might get screwed. The report will at least give you the option to pursure the matter legally if she stops cooperating. Don't chance it unless she slaps the cash in your hand right away. Maybe you sympathize because she is trying to be nice but you shouldn't unless she provides you with the full funds required to fix the bike. If she can't agree to paying for the damages you get quoted then you have a problem.

Your YELLOW, highly visible bike could of been a small kid. She hit your bike with enough force to knock it down and that is more than enough to hurt/kill some little kid. Maybe you should go through insurance because careless drivers should be penalized.

I would do print outs of all the parts and costs for the fix to demonstrate to her at least the part costs.

If all that fails, run over and Kick the **** out of her car. Call it even :)

5k might be high. lol

At least she left a note. My bike was down with nothing. Since she was nice to leave a note for you compromise. Find out total damage and split it. But obviously you are not going to do this.....
I know it feels bad but you are lucky she left a note so that's my advice.

$1,000 or more in damage you are required to report. These days that is just about everything.

I would definately report it to the CRC. Take your own photos with date and time stamp. Cover your arse, hopefully she does the right thing but at least you will have your bases covered if she does not.

I tend to agree here. I mean she did the right thing by leaving the note but you wouldn't believe how many claims start out with the line "get some quotes, lets leave the insurance companies out of it" and end with a claim because the responsible party is floored by the estimate and won't pay it.

Just because she did what she is obligated to do by law you think he should split the cost of repairing his bike with her? That's ridiculous :lol:

Its her fault for being a blind idiot. I'd report it and get it taken care of by the insurance companies. Obviously its way more than $100 worth of damage.

I see where you are coming from but she only left a note thinking it would cost $100 to fix.
When it comes to stuff like this there is no compromise. If you yourself got a quote for $2000 to repair would you be willing to fork out $1000 of your own money? I wouldn't.

What the lady should have done was just hit and run and that would be the end of story, but she didn't and good for OP and bad for her. Now that OP has her info I'd attack this from every angle to ensure my bike gets fixed and my insurance doesn't get touched.
 
I bet she probably saw a camera near by and realize that she was caught on camera doing the act so tries to rectify the situation by offering peanuts.
 
Whatever you do, please keep in mind that she tried to do the right thing. Meaning, if she doesn't want to pay that much, then really keep trying to tell her that it's more than just a hundred backs instead of immediately taking it to insurance. One thing you can do is ask if she knows anyone else on a motorcycle - that person could verify for her that it's more than $100 in damage.

This could set a precedent for her. All it takes is one horrible experience to say "Fuqit, the right thing's way too much of an inconvenience". And even if you do need to take it to insurance, please make sure to thank the lady for her honesty :D
