Big speeding ticket on DVP - few questions

Rob I don't believe 40 is considered a major by insurance. I know for TD meloche monnex they classify all tickets 0-49 over in 1 bracket (minor) and 49+ as major.

It varies, I suppose. Worth checking into with the specific company.
 
if you have a G2 or hybrid license like a GM2, then you can get your license suspended for 30-days for accumulating 4 points

a lot of people are now making the mistake of choosing the 'Early Resolution' meeting as a stalling tactic for the 11b clock, what people fail to realize is that the 11b clock starts when you 'file your intent to go to trial'

before it used to be that you file your intentions to go to trial, and then separately request for a First Attendance meeting; so the clock already starts

now because you requested an 'Early Resolution' meeting first, the clock starts when you either fail to show or decide to go trial at the meeting

you're much better off going to trial, and even playing your luck with an 'officer no-show' than get lubed during the 'Early Resolution' meeting
 
if you get convicted of this ticket, consider your insurance going up a fair chunk for the next 3 years while it remains on your record...say at $50 per month increase for 3 years...it adds up...wish you all the best fighting it...seek council...
 
Rob - When did 41 over become a major? It used to be 50 km/h over (or supposedly 45 with some insurance companies)? Now I see some sources say 31 km/h is a major?
It depends on the insurance company. TD is 49+, state farm is 45+, some companies are 31+. Most of them are going to be switching to the "4 points" rule for majors (so says my source).

I'm just amazed that OP was able to get 41 over on the parking lot which is the DVP :p
 
I just started an online quote with TD for curiosity and under prior convictions they differentiate between a speeding ticket below 49 km/h over and those above that speed. Does each insurance policy treat these major/minor categories differently?

They all set their individual criteria, within reason and within industry guidelines. Some will even ding you for one minor ticket, whereas others leave your rates along until after two. Best to check with your insurer.
 
I was at early resolution this morning. He offered me 15 over and no points. You can chose early resolution and if you are not happy with the outcome you can still go to trial. It took me several months to get a date to meet with the prosecutor and you can change the date once. If anything, it was put off until after my insurance renewal was completed :)

State farm did something really strange with my buddies renewal. He did the same thing as you, put off his plea deal until after his insurance renewal. TWO YEARS later they found out about it, and put on his renewal "surcharge applied until 3 years from the date we found out about it"! He said screw that and switched insurance companies but they added the surcharge to all of the months he was insured between his actual conviction date and the day he cancelled, and totalled them up in the cancellation fee!!

So, seems the days of waiting till your insurance renews to shave at least a year off your conviction surcharges is over, at least with State Farm :(

I didn't realize that it was considered a major ticket... that changes things.

Rob - I trust your judgement. What would you do if you were in my shoes?

I would pay one good ex-cop paralegal traffick ticket fighter $300 or $400 and he will get you off, there's a lawyer mentioned here that charges $500 but he gets you off 90% of the times. I've done this (fight 3 tickets with demerit points attached) and I WON all of them thanks to my paralegal ticket fighter.
