Plenty of people overstay their visas too for various reasons (some just forgot).....I’ve known a few here. None of them were immediately carted off to the clink though and I don’t think anyone called them criminals.
overstaying your welcome is a bit different then sneaking across the border and hiding in plain sight until you get caught, or simply caught trying to sneak over.

You're probably not in ICE custody for overstaying a VISA unless there is a removal order with your name on it ... or you're a convicted a felon facing deportation.
As of March last year, the Trump administration reduced ICE held population to only convicted criminals awaiting deportation. Those without a criminal record are allowed to stay at home as they go through the deportation process.

Why isn't their leader Biden telling them to get back on the bus. Does he not have a plan to save the country? He has killed 10s of thousands of people already... not sure the exact number though as CNN get rid of their covid death tracker the day he got into office...
he has made executive orders for federally controlled areas, you get how the republic works though
