Just curious about any legal aspects as I'm particularly weak in that area.
Say your toodling down a quiet country road enjoying the scenery and a guy on loud raunchy bike comes up behind you, crosses over the double yellow and pins it. You stick your arm out the window and let the camera flash as he comes by. Rider immediately pulls over to the shoulder, waits for you to pass and falls in behind. And follows you for more than half an hour. And other stuff happens, words exchanged, nothing drastic tho.
Can a guy get upset for having his picture taken like that? What if he says "I got your plate number and that's all I need"? Much ado about nothing?
 
If the driver took the picture, and the biker was passing on a double yellow, I'd say both parties would be in the wrong. Why would someone toodling along a country road care to take a picture of a motorcyclist anyways? Scrapbooking?

Nothing illegal about taking pictures or video recordings in public. No expectation of privacy. Otherwise the guy who nailed Ragu would have got in trouble :cool:
 
Bear in mind that in Ontario, overtaking over a double yellow line - on its own without other extenuating factors - is not illegal.

Making it obvious that you took someone's picture could certainly tick them off. It's not illegal to do it, either.

if threats were uttered (by either party) - THAT is illegal.

If someone has the other party's license number - you have his, he has yours, so it could go either way - People can report drunk drivers, people can report aggressive drivers, whether there is any truth to these reports is quite another matter, a lot of these reports are BS and the police know it.

Personally, I don't like initiating road rage, so I would neither take that picture if I were the driver being overtaken, nor stop and follow if I were the one overtaking and saw the other driver do that.

If you have a GoPro prominently mounted on your vehicle, the other driver/rider can see that they could be recorded prior to them possibly making a bad choice ...

Correct me if Im wrong is it not illigeal to have a handheld device in hand while driving?

And is there any law that specifically says its illigeal to cross a double bellow. It could be. But last I heard there wasnt a specific law.

Why would both parties be in the wrong? Nothing illegal about passing on double yellow lines, on the other hand nothing wrong about taking pictures in a public place either but in this case the OP had no reason to take the picture since the rider wasn't doing anything wrong.

The rider should have no expectation of privacy and if he's being really annoying with the loud motorcycle, taking his picture and being obvious about it, is a little bit of harmless payback.
 
Taking pictures while driving is "distracted driving", an offense.

Not necessarily a conviction. I know one is still allowed to use a hand-held cell phone to call emergency services. There might be a provision related to taking pictures. I'll just rock a dashcam instead ;)

That is not somethng I would do, it could easily land you in the hospital, taking pictures is akin to a snitch...and if he was associated with the 5% you better worry.

theres no way that you went for the camera as he went to overtake you..

sounds like you were maybe baiting the rider ?


what was the reason behind taking the picture, what were you going to do with it ?

If you were the rider, you did nothing wrong, unless you uttered threats, etc.

The driver broke the distracted driving law by handling a his camera while driving
 
Let people take pictures, passing on double yellow is legal and it's not like his camera had a speed gun so what gives
