Arrghhh!! got my 1st speeding ticket

I was heading towards Eglinton on yonge(caught yonge and merton) when i noticed an officer on a bike waiting for me. He told me to step aside and turn off the ignition. Then he informed me that i was doing 76km/h in a 50 zone. Asked for my license, insurance and ownership. The officer gave me a ticket for 10km over so essentially 60km in a 50 km zone, 25$ set amount and 40$ payable. I asked him should i fight it and get a deal, he told me buddy this is a deal. If you goto court i will have to bring in evidence for 76km/h. I hadnt checked the ticket as yet as i was gunning to get my job letter from the head office before it closed. The officer seemed like a pretty kool guy, and only later did i find out what he meant by the deal when i read the ticket. He also informed me about a biker who washed by lakeshore and was in pretty bad condition. Told me to drive slow and safe.

Now Should i fight the ticket?

10km over, 40$ payable and no points.

How will it affect my insurance? I pay 96$/M for my GS500F. Currently insured with Statefarm.

unless you have a get one free ticket policy by your insurance company, you will get dinged for it on your next renewal, and it will be a thorn in your side for the next 3 years, until it drops off.....

only other way it won't effect your insurance is if you fight it and it get's thrown out,,,,good luck on that one....

you got to love our Insurance companies,,,,legalized extortionists......

2 minor speeding tickets is a common grace. If you've got that (I'm with SF and I do) then I'd just pay the fine and be done with it. He could have dinged you with 3 demerit points for going 24 km/h over but didn't. Fighting it in court could get you a guilty verdict at the original speed.

Just keep an eye out and try not to get yourself into my position where I'm constantly juggling a third ticket in the court system while waiting for another to drop off my record. In case you do, keep a record of your conviction dates (not ticket dates) so you'll know when each ticket is due to drop off.

State Farm are the worst when it comes to tickets. ONE 6km/h over ticket pumped my policy up almost $500 a year. Friggen jokes. I changed insurance companies when my policy came up for renewal.

That's odd... though come to think of it, I already had 2 minor speeding on my record when I joined SF. The agent told me it was fine. My buddy joined at the same time with zero tickets on his record. The difference in our premiums is minimal.

Fight the ticket, unless you know you're not going to get another one in the next three years. There is no deal the officer could have offered you other than dropping it.

State Farm has told me that they will drop riders with 3 minor convictions.

I thought insurance companies don't really check your file unless your'e deemed risky or as part of random sampling every year because it costs them money to extract info from the DMV?

My girlfriend had three speeding tickets at one time (in a car) and her insurance didn't go up at all (With SF).

Pretty sure they check upon application, and then every time your policy comes up for renewal.

Is the ticket marked with an R for reduced? If it is, and you decide to fight it you can end up with the original fine and points if you lose in court.

You can always request disclosure and see if you have a case.

I checked and it says R under code. I think i should pay it. Thank God i didnt get caught doing 180km/h, that would have been a real pain. Also this would serve as a reminder for me not to speed.

It's your call, man. Hopefully your premiums don't go up as a result.
If you got caught doing 180k, I doubt anyone would insure you after for a reasonable price... not to mention all the other headaches that come with that. Personally, ever since that stupid stunting law took effect, I'd just keep on truckin if I was pinged doing 50 over - nobody's takin my bike on the side of the road. Prior to that law, I woulda pulled over every time.

Not necessarily true. The Motor Vehicle Abstracts cost the insurers $$. It's cost prohibitive for most standard lines (not high risk) companies to pull them on EVERY active policy driver. Usually if the current one they have is less than 3-4 years old and it had 1 or less minors, then it's less likely.

Under 25s, newer divers, new policies and or high ratings, many comprehensive or collision claim(s) or multiple prior tickets, then you may have an abstract pulled more frequently.

But if you've been with your current company for 3+years, no claims, good driving record and no prions, then I wouldn't lose sleep over a 10 over. However, other posters are correct that your next ticket within 3 years could cause you significant issues.

I'll take your word for it ^

This is absolutely 100% correct information, at least for State Farm.

Also, if you think you can "get away with" them not finding out about your ticket, it's almost impossible! Lets say your policy renews Jan 1st, 2013. You keep putting off your court date and plead guilty on Jan 10th, 2013, after you've already renewed your policy. You're thinking "Great, at least one year I won't be paying extra, maybe more!" Lets say two years and two renewals go by without a problem, but on the 3rd year they run your record and see your ticket. They increase your monthly rate TO INCLUDE THE MONTHS YOU WERE PAYING LESS WITH THE TICKET ON YOUR RECORD! Yes, that's right, they back charge you from the day you were convicted! That's why you see some people say "OMG my rate went up huge for just one ticket!" that's usually because they got the first year "for free"!

My buddie thought this was all fine and dandy and cancelled his state farm policy to switch to another company, figured screw that crap! Well, they just rolled the surcharge into his cancellation fee!! The charged him extra for every single day since his conviction until the day he cancelled :(

My thinking is if you can go four years without them checking your abstract (unlikely), that'd be the only way to squeak by without paying extra.

Said like the soup nazi on Seinfeld "No discount FOR YOU!"

There are ways that you can end up on your insurer's RADAR, and end up being checked at every renewal.

Your read about my ticket, what do you suggest since you have a lot of experience with these matters.
I am replying in the thread, for the benefit of others.

Because this is your FIRST ticket, it's a great time to practice the entire run around we call the justice system. If you're found guilty and it gets amended back up to the original speed, you'll pay a higher fine and lose a few points BUT WHO CARES! :)

My rule of thumb is FIGHT EVERY TICKET AS IF YOUR LICENSE IS ON THE LINE!

If you just plead guilty and pay the fine and let this one slide, next year you'll come crying to us "I got two more tickets so now I have three total and state farm cancelled my policy and now I have to pay $500/mo with facility instead of the peachy $96/mo I'm paying now!"

My advice: Take your ticket in, request a court date, tick off the boxes "I will contest the officers evidence at my trial" and "I wish the officer to be present at my trial" and "I have legal representation".

Once you get your court date in the mail let us know and we'll come up with a schedule for when you should request disclosure, and we'll help you request it too.

Make a new friend that has a scanner and scan both sides of your ticket before you take it anywhere. Do it again after they stamp it.

Do the same thing with your court date notice when you get it too.

Good luck.

I had to come to Canada to hear that insurance rates increases when you get spending tickets, just because we get a speeding ticket 20 or 30 kph over the speed we are bad drivers or riders? I don't think so in a matter fact I think people that drives at low high speeds sometimes way lower then the speed limit are more dangerous. The rates should only go up if we get into a at fault accident. Plus, a 100kph on a highway??? Maybe 100 years ago would be right. Insurance companies are robbing us everyday, I just don't know how they don't go to jail lol. Plus for the cops it's easier to give a ticket to someone that shows their face or it's on their way to work instead of catching the real criminals

I would suggest that one should practise their right to have a trial. I would book a court date and ask for officer to attend. I fought my last 3 three tickets like that (ALL REDUCED) and officers were kind enough for not showing up to court. All of them were tossed out:D. I am with state farm too and i think they dont care about 1 or 2 minor convictions.

Not sure I believe this one! I got a ticket yesterday, was going 121 in a 70. It was my first conviction and she dropped it to 20km/hour. Fight or no fight
