any LAWYERS on site? that can give me good advice? I want to sue another lawyer for bad practice and improper handling a file.


Long story short I bought a house and closing was March 1st and it didn't close until March 13 at 5pm.
Lawyer was acting on both parties seller and buyer (me). She ****ed up large and didn't run a title search until 3 days prior to closing to only find she had to deal with with creditors that had liens attached to the house. Not only did the house not close the Thursday, she ****ed off to Cuba Saturday morning for 1 week.


Now the good thing was I still had my current place till the March 24[SUP]th[/SUP] weekend so I wasn't living on the side of the road till it closed. She offered to pay me $125.00 a day till it closed so 13 day total. I have not agreed to this yet.




The bottom line is she ****ed up large. Yes I am bitter

Without going into details, I once retained a lawyer for a long, drawn out matter. Assuming the lawyer was competent, I took his word about everything (I was unaware of all the legalities at the time).
After being ****ed over for $120K, I found out he was NOT competent. (I spent months at the library going through case law).
Upon finding out how I'd been ****ed over, I contacted the Law Society of Upper Canada to help with some sort of resolution to the matter. Their responce is generic. (I've found out from others since).
They will get back to you and advise you to: "find a lawyer to help solve your problem".
Well - good luck with that. It'll be a cold day in hell before you find a lawyer to take on a "brother / sister".
There was a firm in Toronto that would have helped me, providing I retained them with double the amt that I'd lost, and no guarantees, of course. Needless to say, I was a little short of $1/4M.
Just hope the matter clears up by move in date Rich, and try and forget about it - the $125 / day is something she didn't have to offer - take it.

thanks Gary..... i spoke to a couple people today plus filling a complaint form with the law society ... Just sucks that she ****ed me around and should have had all this done and cleared by march 1..... knowing she was sitting on a beach for 8 days drinking margaritas pool side well i was at home stressing if a had a place to live after march 24th...
 
Is there an agreement to have the lein's paid by the seller? If so negotiate $200- $250 a day with some sob story how your family of five had to shack up in a hotel, the food in your fridge went bad, and you had to board your dog because the hotel did not allow pets.

The average cost of civil ligitation in Ontario is approxiamately 50k. You can decide what dmg you have suffered.

Complaints about lawyer competence are dealt with by LSUC.

on that note knowing that she dropped the bomp and i have prof that she did what are the chances a small guy like me wins against a lawyer?..... i was also informed today that i would have to take it outa city is this true ?
 
2 things Rich.

1) Get the money first then bend her over.

2) have proof of everything you say about her. That goes double for anything in writing.

really just let her walk away like nothing happen???? just because i still had my place doesn't mean i didn't loose money.... heat, hydo, 100 long distance calls on my cell, 3 full days off...ect...

I don't understand what you are expecting to win.
 
An ex of mine had surgery done on her in Toronto, was a general type of thing ( as far as surgeries go ). Anyway, the Surgeon nicked an organ inside of her and then just sewed her all up and took 3 weeks vacation. She was in tremendous pain in the hospital and none of the doctors wanted to touch her for fear of being sued. In the end, no lawyer would do anything, because none of the doctors would say anything bad about said Surgeon, they all teamed up against her and she didn't have a foot to stand on against all of them.

Point Im getting across is that Lawyers generally don't sue each other unless we are talking major payout with a sure win. They are buddy - buddy, and who want's to challenge each others law degrees, it's a lot of work.

slap on the wrist from someone from the LSUC, a big X on the firm...


Disciplinary measures are the realm of LSUC, courts only deal in compensation. It does not appear from what you wrote that you suffered financial harm beyond the compensation offered to you.

I agree with those who say take the money. You can always register a complaint with LSUC later but, realistically, the job of a civil litigation is to "make you whole." If you take this to court, you would be hard pressed to demonstrate any actual damages. Save thousands of dollars, and your blood pressure, and take the $125.00/day.

you are wrong, suing lawyers is very common, thats why we have ridiculous professional insurance.

I just assumed they didn't. In the issue I posted though, it was my ex versus 8 highly regarded Surgeons saying " nothing was wrong. "
