If the unit is set back according to the by-law which you already put in your initial or 2nd post, then the unit is in compliance, and it can stay where it is, sorry for the bad news....
Only thing you can do is possibly raise the fence height, add some privacy lattice, but stay within the fence height by-law
don't go by where the fence is, unfortunately they move and can give you a false reading for the property line, when you purchased the home you would have gotten a survey of the lot, this will tell you the boundaries, follow them, and with that you can then determine if the unit is too close.
