If weed is easily accessible is that the same as having an open bottle near the driver? It’s a pretty serious charge even if you’re not drinking.
The specifics of that one are interesting. If you have weed but no way to light it, are you still guilty? What are you going to do, chew it? Seems unlikely for many reasons. If you put it in a heat sealed bag, is that ok? Like a sealed bottle of booze at that point?

I smelled weed. That one would be a bugger to disprove in court. The cop is a friend of the court, you can't document the smell (or lack thereof), he said/she said, you lose.
