If the bike is leaned on the public street to the degree where ABS won't work well - you're riding way too fast! I only have an experience with the latest BMW ABS and it works very good.

There is absolutely no excuse for the car driver, but if OP bike had ABS probably nothing would've happened. Maybe, that's the reason why Europe makes ABS mandatory on all street bikes in a couple of years...

You're right. The bike has plenty of power! PCIII fixes the stumbling and jerking at low RPM. But if you don't want to go this way, take the bike to a dealer and ask them to install the latest software on it. That should make the bike run a lot smoother.
