Scenario ... Uninsured bike stolen gets into a crash ?

There are no insurance companies involved in that situation, which simplifies matters considerably.
 
I was talking about my post in regards to lending a spare track bike to friends for track use... who has liability if they crash and damage or hurt others.

Potentially yours. What's to say that you were not negligent in maintaining your bike and that said negligence played a role in crash? The friend you lent it to could sue you.

Victims can sue anyone who had a hand in the loss, the rider who crashed, the owner of the bike, the track day or race organizers, track support staff and the track itself.

The waiver doesn't change anything. You cannot sign away your responsibility for being negligent, for example.

Historically - and, thankfully - the track day / roadracing crowd have not been lawsuit-happy, and hopefully that doesn't change. But ... If your bike that you lent out has some sort of major fault, and you lend it out, the rider you lend it to theoretically could sue you. (Just because it could theoretically happen, doesn't mean that it routinely does happen. But it could.)

The only track-related lawsuits that I'm aware of, happened because insurance companies got involved.

I was under the impression that, if the victim dies or is critically injured, their spouse can sue for losses (Income, the kiddies etc). Even though the rider signed the waiver the spouse probably didn't.

You think others track riders would do the same? Lets see if one dies due to some idiot spilled coolant on the track...

As far as i know there is no way for you to stop anyone from civil lawsuits so i wouldnt be uptight if i were you
 
I suppose I should eventually look up the exact amendment for everyone, but I'm too lazy. I went to Service Ontario last year and found out the hard way on a car I had stored. That is all.

Sounds to me like you found out the hard way that some Service Ontario clerks are ignorant goofs. Or you completely misunderstood what you were being told.

You can own as many unplated and unregistered vehicles as you want. Its a lump of metal.

Spouse can sue, parents can sue, anyone who can claim some sort of loss can sue. The waiver means next to nothing. The waiver is little more than a paper tiger.

Completely 100% correct .....know first hand signed waiver not at track and yes owner found negligent and insurance paid out within 3 years of injury in mediation phase

Irrelevant, and I can put whatever I want in my garage. Most bylaws are also only enforced on complaint. If you keep rustbuckets littered around your front lawn and driveway then yeah, good luck.

Thanks for the reply guys. I think SV650 would be my best bet. I want to have more time on one bike until my skill is improved

My stree bike experience is not consistent, also with tons of bad habits. I've riden nsr125, rgv125 , bw 50, ninja 250, zx6r, ducati monster, rebel 250 and Ruckus. Most of them are overseas and not in Canada. I dont have much time to ride on street so i figure might as well do track days only from now.

My most concern with used track bikes is longevity ....as its usually abused alot more than street bikes

For the most part, it's not experienced track riders that you need to worry about ... it's yourself.

There is a bylaw in my 'hood that says that you can't park a company work vehicle (ie. HVAC, construction, coffee truck) on your driveway overnight. Yeah, try enforcing that in da 'bridge lol
