Got hit by a driver on thanks giving in Brampton while raining.

He can't file for a hit-and-run because he TOLD the guy he was free to go/wasn't going to get police involved. Well, he might be able to, but that would make him more scummy than the driver (if he was indeed drunk.)

BUT it seems like the driver isn't paying up so filing a hit and run would be reasonable to get your money back that they refuse to pay

No. You call insurance. That's what it's for. You have up to a year to make a claim. I've done this many times when people didn't pay up after they said they would. Insurance gets a little bitchy that you didn't call them right away but otherwise it's fine. All you need is the plate # and they can find him if the OP didn't get his insurance info (which he should have, regardless of their agreement).

What unL33T said plus it's not a good idea to file a false police report.

It's not hit and run, when the other driver stops. They came to an agreement after the collision, which makes it more of a breach of contract. Contact the other driver and see if he'll pay. I doubt that the people involved traded insurance information, so it's unlikely that there's enough information to make a proper report to police and insurance.

I don't recommend that people make one of these side deals when insurance should be involved but if you do, make sure that you get all of the information you normally would if you planned on going through your insurance. You might have to anyway.

Well personally I like when other people give me the option to avoid an insurance hike if it's just a little ding or a bumper replacement or something so I try to extend the same courtesy to other. Yeah, most of the time they will give you the run around but not always. As long as you get all the right information you should be pretty safe.

I know some lady cut me a deal a few months ago and, even though her husband told her I was going to screw her on the payment, I did not and I ended up making a friend out of it actually. Told my gf I was keeper too since I was so nice to her. Nicest lady I've ever hit. She actually apologized to ME for asking me to pay anything. Even then she asked me if I was a poor student and made sure I wouldn't have trouble paying my rent or buying food.
 
Out of curiosity, if you report the accident does it automatically go to ins or is that separate?

BTW since you work in construction the damage to your knee might be the biggest problem here. You cant get a new knee from the dealer. When I high sided it took 5 days for me to feel pain in my wrists. It's been four months and they still hurt.

Report to whom? The police? I've always heard it does but when I called my insurance about 2 months after some guy that said he would pay but didn't hit me and I had called the police, they did not know about it.

Insurance tends to care more about you making a claim, than being in such an incident. If you or the other party don't make a claim, then it doesn't impact their bottom line. Reporting to police is not making a claim to your insurer.

Now if you get charged with something because of the incident, then that's something else altogether.

I don't want them to lose their house. I just want them to stop DUI. If people got the message from a common sense poster thats fine by me. If we have to start cutting body parts off because the message doesn't sink in then sharpen the knives.

People lose their jobs, families, houses and still keep DUI. What is wrong with the system? The risk of suspension isn't working as a deterent.

The very few people who still drive while impaired are the hard cases, who will never learn any different. Generally the courts let them off lightly, the first couple of times. Once they are actually under suspension, they still continue to drive. If their car is impounded they'll find someone else's to use.
