I have to sort of agree -- I could see that car was about do to something well in advance of anything happening. Not to mention I don't think the rider even attempted to brake at all, they just swerved in front of the car (aka the wrong direction). At almost 2 seconds that should have been more than enough time to stop at only 28mph.

He was riding faster than his ability to come to a stop in an environment where there was a very high chance of needing to stop suddenly.

So, maybe he wasn't at fault but he's still an idiot. Doesn't sound like he learned anything from it either based on his responses to the comments.

"Well she should've looked, so I didn't brake I just tried to go around." WTF kind of reasoning is that? I see a car pulling out in front of me on any mode of transportation and I'm on the brake and on the horn.

He had a tons of time to stop, and I love how he put his right leg down right before impact...

I read somewhere (either on the youtube or linked Ninjette thread) that he was trying to 'kick the car' -- Well, unless he is Chuck Norris (or possibly Jack Bauer), I think using brakes would have been the more effective action lol.
 
So obviously defensive driving/riding courses were not taken for either one of these individuals... She didn't look and he obviously was not paying enough attention to the parked cars. Also he's a little slow on the uptake if the car made it that far across the street before he reacted.

Knee-jerk "blame the driver" attitudes don't help anyone. It's a shared responsibility being on the road, if your approach to avoiding incidents is to assume everyone else is looking out for you then you'll have a short riding career. I sure hope the sentiment that "it was her fault" is comforting enough for this guy while he's laid up with a busted leg and bike.

Pause the video at 37 sec., you can clearly see the car's reversing lights activated and front wheel pointed to the middle of the road. Now look at the distance the rider had to identify the threat and respond from that point (assuming he was really traveling at the speed he claims). From that initial point of hazard perception I count four car lengths plus the driveway in between, that's roughly 20 meters, more than enough time to stop.
 
Lousy rider, he had time to swerve and the entire left side of the road was open for him to do so. Whats up with 3 camera angles anyway? bit of overkill just to go riding to work or whatever he was doing. It's like he was setting it up to happen.

If the car had been at a DEAD STOP in that lane he still would have hit it. The only reason he's not 100% at fault is because the car's wheels were turning.

The reason that his leg is broken is because he froze and didn't even touch the brakes and that is 'his fault'. But the reason that he is not at fault based on insurance laws has nothing to do with moving wheels tho. Only that the car was either A) entering traffic from a parked position. Or B) was making a U-turn. You could really pick either. but the rider does technically have right of way and does not need to swerve or brake as that is 'his lane'. That being said......he really has no one to blame but himself for the pain because there was TONS of room to stop.
