Purchased a swing arm with the help of my friend, and to my surprise when I finally got the swing arm back to Ajax, it was not from a 2010 Honda 1000RR as seller indicated. In one of my email to seller, I specifically inquired if the swing arm was from a 2010 Honda 1000RR and Mr seller said yes.
I’ve tried to settle this matter with seller, but he hasn’t responded to any of my emails, so I’m now going to do it the hard way; small claims court and the police.
I’ll try and keep this post updated with respect to the outcome and what to do if you’ve been scammed on kijiji.
As of now, Kijiji says to report it to the police and have Law enforcement agencies create a ticket under the topic of "Report > Law enforcement inquiry", or by sending us a letter by registered mail to the following address:

Seems like you got screwed by someone on kijijji. Don't waste our time on this stupid dispute, take it offline and sort it out somewhere else.
 
Police will not interfere...Civil matter between the Dude and you to be settled in small claims alone
 
Lol. The police wouldn't care if he straight up scammed you for money, nevermind just you didn't do the homework to confirm fitment from pictures beforehand. Not even the sellers fault. Did you not get pictures to confirm? Anything?

You did not get scammed, figuring out if it fits your bike isn't the sellers job, its yours.
 
How much was the swingarm? You do know that you have to pay to take someone to small claims court, correct?

Swingarms are relatively inexpensive. Just try to re-sell it and move on, not worth the hassle.
 
Since i buy stuff from Kijiji, i am interested, so please update. Not sure how you guys know what oem/aftermarket part fits which bike, year, model etc.

I didn't know you have to pay to go to small claim court.
 
Sorry to hear that Xray. Small claims will pay out for direct loss, but not wasted time, or hurt feelings, so be cautious if you choose to proceed. I believe you can get a 30-minute free consultation of legal expertise which is likely the best way to proceed, although they will not do any legal work. Honestly it sucks, but without an explicit contract or signed agreement, this could be an up hill battle. A formal letter from an attorney or serving notice might motivate them to at least reverse the deal, but how much fuel and time go into the effort? Keep in mind you'd need to serve papers in person, usually. Windsor is a bit of a drive, and you'd have to file there assuming that's where the 'incident' took place. That's a minimum of 2 trips.

If it's worth the $ you paid, resell it for the same....or for less and cut your losses. ...and learn from this experience. Never completely trust 3rd party sales. You need to be sure of what you are buying.
 
This is why you must always know the part you're buying. Never rely on the seller (lots of them will tell you anything just to sell the part). Police are unlikely to lay fraud charges. You can have a lawyer send him a registered letter, or take him to small claims court. Not a bad idea if you paid a lot for it.

It costs approximately $1100 to see a small claims case all the way through assuming you have some method of enforcement. Not sure how much this is worth it for you, especially as I assume you have no method of enforcing a judgment. Of course I am just making a couple of assumptions so...

Damn. I didnt know it was that much. As you say, a judgement probably isnt even worth the paper it's written on here as the seller will just tell the buyer to screw off again.

You need to do your own due diligence when buying used parts etc from individuals. Yes it sucks that you were lied to by the seller but it isn’t the job of the police to make sure these transactions go smoothly. I doubt I’d waste my time and emotional energy fighting it in small claims. Like mentioned try to figure out what the part is for, resell it and move on.

If I was purchasing used parts on Kijiji I'd do my research, look for a part number on the part you're buying or at least bring the original part you're trying the replace to compare with the one being sold.

You really have zero proof this guy tried to rip you off. He might have intentionally ripped you off or maybe he legitimately thought the part was going to fit. It's your word against his. This aside, if I had my full name and number posted online with an allegation you've laid out I'd be calling my lawyer and suing you.

You should edit your original post and delete everything and, as others have mentioned, cut your losses by identifying what bike this swingarm fits, sell it off and move on.

point one. I see where mr sheran says "cbr1000 , fits many years" , I dont see an email where he says its a 2010 specific. You may have chosen not to include that, whatever. If its a Honda swingarm, its got a part # on it. If you asked and he thought close enough, well he wasnt guessing well and your buddy didnt check the part #, since he probably didnt have one, so your screwed. Unless this part is worth 2K, going to small claims court is a waste of time. You may have gotten hornswaggled , learn form it and move on.
And if my full name was listed in the opening post on the internet with an alledged fraud, you'd have my lawyers letter at your door already. Asking for considerably more than a swingarm is worth.
