Turn sign

Last year (last summer through this spring) was a most terrible time for me.

The last ticket I got in April for a turn under the sign. The sign had a time till 6pm. I was riding 2up with a friend of mine. She was living in that block, and I did not pay attention. It was only 5:20.

I got the trail on Nov 16th. I got a copy of a hand-written disclosure.

Is there anything else I can do except hopping for the officer not showing up?

Was this a bylaw ticket or a HTA offence ticket? If bylaw, I wouldn't sweat it much. If HTA, then I would try to plead it down to something like "impede flow of traffic" instead.

How does the disclosure look? If you want I can give it a look over and check for mistakes, e-mail it to legalhelp@tafb.xxx

If you can e-mail a copy of the ticket too that'll help. If not, what's the exact charge? The code written on the ticket...

I got the e-mail, thanks.

Can you read the cops notes? They make absolutely no sense. If your court date wasn't coming up so quickly I would submit a request for ADDITIONAL disclosure and ask for a "transcribed copy of the officers notes". In fact, I would probably do that RIGHT NOW anyway. If they don't come up with the additional disclosure there is a chance the judge will dismiss your case. The notes are pretty useless in the form they are in now.

Scan of ticket is clear, charged with s144(9) disobey sign: http://www.e-laws.gov.on.ca/html/statutes/english/elaws_statutes_90h08_e.htm#BK222

"Signs: (9) The provisions of this section are subject to any sign, as prescribed by the regulations, forbidding a left turn, right turn, through movement or combination thereof that is posted at an intersection and every driver shall obey every such sign. R.S.O. 1990, c. H.8, s. 144 (9)."

I assume this is the sign: http://goo.gl/maps/XL9xF

I did some reading on the s144, since they did away with the "bi-lingual sign" requirement there isn't much defence for it.

If you can afford the day off work I would just hope the cop doesn't show. If you can't you can just go and pay the ticket at your convenience (any time prior to your court date).

Prosecutor said that the officer was present, so I agreed to a reduced fine...

When I was on the floor after, I did not see the officer anywhere around. Damn, did she (prosecutor) lie???

Yes. They do that quite often. For future reference agreeing in principle to a plea bargain doesn't mean you MUST follow through with it.

Probably the officer was not there
Probably the prosecutor knew
But you have no way to prove it

I have seen this same situation happening too... lady agrees to plead guilty with an explanation in exchange of a reduced fine (for no insurance slip available to show to the cop)... but the cop is not there.

Where did you see that the bi lingual sign is no longer required? HTA seems pretty clear that it is required.

R. v. Petruzzo, 2011 ONCA 386 http://www.canlii.org/en/on/onca/doc/2011/2011onca386/2011onca386.html

The City of Toronto is designated in the Schedule to the Act as a bilingual area, and under s. 14 may pass a by-law providing that the administration of a municipality shall be conducted in both official languages and that all or specified municipal services shall be available in English and French. However, the City of Toronto has not passed such a by-law. Because it has not done so, s. 52 of Regulation 615 under the Highway Traffic Act applies and forecloses the need for bilingual traffic signs. Section 52 states:

A municipality situated in an area designated by the French Language Services Act is not required to comply with the sign requirements for such areas unless it has passed a by-law under section 14 of that Act.
So, in the city of toronto, currently, there is NO requirement for bilingual signs.
