I was test riding my gf's 250 before I was gonna pass it onto her. After I picked her up, and went about my way to ride back to my place in order to pick up my bike so we could both ride, I got tail gated by an "undercover cop".

At the time, I had no idea who the hell the person behind me was, I just knew that they were hella close. A vehicle beside me was also blocking my ability to change lanes...so, I did what any sane Asian man would, split between the two cars infront of me. Shortly after, when I stopped at my house, the same tailgating jackass waves a sign at me, in his windshield, that said police. He comes out, puts a vest that says police on, does not show a badge, and starts threatening to charge me with careless, dangerous, or call my insurance to tell them I was riding dangerously.

I didn't wanna piss the guy off incase he was an actual cop so just acted pitifully and said nothing (due to learning from somewhere here to never talk to cops). Eventually, he just left.

My gf told me she saw the guy holster a gun, but I wasn't paying attention. What would have been the correct action in this situation? And don't say "don't lane split" because my *** doesn't like being tailgated and I'm sure yours doesn't either.
 
Tap your breaks and hope he backs off?

....that would involve trusting someone else in the road from not trying to kill me; which is against everything I've been taught. And I'm not referring to actions taken to avoid lane splitting, I'm asking specifically to whether or not the "cop" violated rules or if it's okay for a random jackass to impersonate themselves as a police officer. Hell, I might just do that next time then too (get a random police sign, get a random vest that says police, pull ppl over, yell at them).
 
Well, lane splitting is illegal, tapping your breaks isn't (I don't even think it's illegal to tailgate, someone else probably knows for sure. Just dangerous and stupid). Impersonating a cop is, I am pretty sure, I would have taken his plate # and maybe called the local cop shop and asked about him, if you are that concerned.
 
Flash the brake lamp and motion with your hands for the driver to back off. If this happened in the city, a rearwards glare when stopped at the next traffic light. I've never had this NOT work.

Under the circumstances, If you got a license number and/or description of the car that the cop was driving, I'd file a complaint.
 
Really, how long were you on this road that had no turnoffs, driveways, or parking lots?

Next time, just pull over somewhere, not very hard to do...
 
Be careful with flashing the brake light. Depending on the cop, it could be grounds for HTA 172
 
I don't see ANY plausible way for flashing a brake lamp to cause a stunting charge. Weaving around ... that's another matter.

For sure, as soon as the OP found out that this was a cop, should have gotten some way of identifying (car number, license number) and filed a complaint, because this sort of tactic by the police needs to stop.

Sound advice. More drivers tailgate because they're daydreaming (cops included). Tapping the brakes (NOT brake checking) wakes them up. It could have been a phony officer, but most would have tried to extort something from you. The rarer ones play at traffic patrol for whatever reason (with accessories).

Still, an actual officer could have scored an easy stunt racing charge. I agree the "pushing" tactic used by some police departments is dangerous and despicable.

I still think it's utter ******** that lane splitting is an HTA offense; especially since the only person that could possibly get injured is yourself. But hey, maybe this is just because I grew up watching lane splitting in Taiwan.

Flashing the brake lamp is neither stopping nor slowing down, and reminding the driver behind that they are too close is a circumstance where the driver behind "should" ordinarily slow down. Not applicable.
 
One other small thing. It's probably worth paying a visit to your local police department and file a complaint even though you don't have an identification of the officer. If you know the time and place and a description of the incident AND if it was an actual unmarked car, they should be able to track it down.

In the interest of getting the police to stop this tactic ... do it.

I agree with you that it's not applicable but I wouldn't put it past some officers to charge someone with it anyway.
 
Is anyone blind? The "guy" puts on a police vest.
First off, that is illegal. He either has his vest on or off, and has to show which agency they are from. Second, record his plate number and file a complaint for impersonating an officer.
