Stunt Driving ticket

The other day i picked up a ticket for stunt driving while in a group, some got away some didn't. The cop never pulled me over but came to my house the next day to serve me the ticket. He says i was weaving through traffic and not going with current flow. I have a clean record, no tickets at all. I disagree with the charge completely, so how should i proceed.
  1. should i go it alone in court?
  2. get a paralegal?
  3. how should i plea?
  4. has this happened to any of you, how did you proceed?
 
1. I would hire a lawyer. If its stunt driving you have to meet with the prosecution first to plead guilty or not guilty, you don't need a lawyer for this.
2. Paralegal is up to you.
3. Plead not guilty, if you plead guilty thats a min 2k fine and insurance will be screwed.
4. I am currently in the process of going through the process (got tagged last week), and just take it slow. Lawyer up when necessary and don't cheap out on the lawyer!
 
You may be able to get off as the Cop has no guarantee that it was you riding: Anyone could have put on similar gear and rode on your bike illegally. Don't take my word for it as I'm not a lawyer or anything, but this is the reason why when you get a red light camera ticket you don't get convicted, because they cannot prove that you were the person driving. You will only get convicted if you are pulled over and the cop identifies you as the driver. Remember it's their onus to prove your guilt, not for you to prove your innocence.

You should definitely get a consultation from a paralegal or traffic ticket fighter though.

Did he take your license and bike?
 
they can't prove it was you...did they do this to any of the other riders you were with....also how did they get your plate? the guys that got caught gave you up? if so that's brutal.
 
DID the police see it happen? The OP says he got the ticket while "stunt driving while in a group" and that "some got away some didn't". Maybe the cops tried to flag down the group and some pulled over, some fled? Later, back at the station they go over camera footage from the car and run the plates of those who fled so they can show up at their doors bright and early the next morning.
 
RULE No. 1: Don't talk to the police. RULE No. 2: See Rule No. 1.

I hope you did not answer any of the officer's questions.

Continue to not answer anything other than what you are legally required to answer ... which is merely to identify yourself.

A frequent tactic by the police in these circumstances is to threaten and intimidate in the hope that people incriminate themselves, so DON'T.

If the police did not pull you over, they cannot prove that you were operating the vehicle at the time and place alleged.

HTA 172 allows the police to impound a vehicle which has been involved in "stunt driving" without regard to who was operating it, but unless you incriminate yourself (or there is other evidence) there is a good possibility that the charge won't stick in court.

Remember to ensure that all of your riding buddies also say nothing to the police.
 
I would also get rid of the part in your posts that says you were riding in that group. As far as anyone is concerned you were home masturbating. Admit to nothing and deny everything.

What Brian P said is spot on. Follow his advice. This is an easy case and redline can easy get you off.

It would go something like this:

Crown: Where were you at the time of the incident?
Accused: At home
Crown: What were you doing at home? Do you have any witnesses?
Accused: masturbating... only witness is my Betty.
Crown: Who is betty?
Accused: My left hand.
*face palm*

also...if he was caught stunting...should they have not towed his bike?

or it was after the fact...and he got away?
 
some got away, some didn't...guess you almost got away...see who out of your buddies did and did not get a ticket, if all but one didn't, you know who sold you out...hahaha

But did he tow your bike? Only thing I can think of that might screw you is if it was a police vehicle that had an onboard camera and your license plate was caught on it. At that point you can be charged with running away from the police etc....

I hope you didn't admit to being on the road at that time. In any case you need good legal representation.

You MUST admit who had your vehicle, otherwise you are interfering with the investigation.

I never ran, the cop car drove by me on the highway. he had the the chance to pull me over but didn't
