statefarm put accident under my name?

Hi,

Back in 2008 my mom had an accident with another car (at fault). I wasn't living with them or was anywhere near the accident place. I was helping my parents deal with the adjuster and for some reason the accident was put under my name.

Now I called to get an insurance quote and they were listing my accidents and this came up.

How do I fix this?

Edit: just spoke to my parents they were insured by Aviva at the time not statefarm...

Get a drivers abstract and see what it says and then take it and any documentation you hav eabout your moms accident to the MTO and have a talk with them.

Was your moms insurance under your name at the time of the accident?
 
The MTO can't help you. You need to call the insurance company that made the mistake and explain it to them. They should be able to fix it as well as give you a letter of experience to show the new insurance company that it was an error and was not your fault. If you don't get the results that you are looking for than you need to contact IBC.

Yeah I don't think MTO cares.

The MTO can't help you. You need to call the insurance company that made the mistake and explain it to them. They should be able to fix it as well as give you a letter of experience to show the new insurance company that it was an error and was not your fault. If you don't get the results that you are looking for than you need to contact IBC.

At the time, I wasn't insured or driving. I was just helping my parents with their claim. I don't know how or why my name got on it.

Do I contact statefarm headquarters or something? What documents should I have with me when contacting them. If you have a number to contact that would be greatly appreciated. Thanks.

Edit: I found some of the correspondence emails in my old email address.

Call 888 999 0750. That's state farm claims. Have the old claim number with you and the approximate date of loss. They should be able to hook you up from there

It was my mistake. It was with Aviva. I'm going to call them tomorrow.

Thanks I appreciate that. I'm trying to find out what my old insurance policy number with them was... I don't know how to find it. Any ideas? Atleast this way they can reference something. I just have a number on the email that might be claim number or some sort of reference number.
 
It could just be an FYI in your file, but not have any impact on your insurability. If your parents had you listed as still living with them or as an occasional driver on their car, the claim would show up in your file as an FYI. My ex husband filed a claim on his policy for his work vehicle, and since we were living together, it shows up on my insurance history. Doesn't have an impact though on my rates. I was alarmed at first when another company told me about it, but when I then looked into it I was informed that's just the way it is.

I've had this happen before too. Brother's accident showed up on my record. They refused to correct it. Outright refused! They said it happened more than X number of years ago and can't change it, however, it wouldn't affect my premium because it was so long ago. I asked if they'd put a request in with whomever to get it fixed anyway and they said no we won't.

Yes it can be taken off your record but not by the insurance company

you'll need to contact a lawyer

Wife's Cousin had a No Fault added to his record as a 100% at fault and had to go through the whole ordeal

You don't need to call a lawyer. This is pretty simple.
First off the # for Aviva claims is 866 692 8482. If the reference number you have ends in 'PLA' than it is a policy number. If it is just 8 numbers than it is likely a claim number.
Call Aviva directly and explain the situation to them. They will probably refer you back to your broker, but it is a necessary step to call claims as they will note the claim with your concern. When you talk to the broker, again, explain the situation and let them know that you've already spoken to the claims dept. Then you need to ask for 2 things. First you need a letter of experience (also called an experience letter) This is a letter that you will keep with you and produce to other insurance companies when they quote you and try to tell you the accident is yours. It's simply a 1 page letter that clears up the confusion and says that your Mom was driving at the time of the accident and was also the RO of the vehicle. A letter of experience supersedes the autoplus report that is telling the insurance company that the accident is yours. Second, you need to tell Aviva to contact CGI and correct the error. CGI is the company that tracks claims for insurance companies. It will not happen quickly but there is no reason that they shouldn't be able to correct their error. Just note that all of this information is on the assumption that you were not in the vehicle, on the registration, or on the policy as a listed driver at the time of the accident and were only involved in the claims process by calling in and helping your mom.

I actually applied for an insurance abstract. I'm going to get that first see what it says and then go from there.

I wasn't living with my parents and was not listed as a driver at all on their policy. I was just communicating with between them and the insurance company... their english isn't the greatest.

The number I have is a cliams number not a policy number. Maybe the insurance abstract will show the policy number.

Wasted already wrote everything I was gonna write. Follow his advice, you do not need a lawyer to get this straightened out. I have gone through this process twice (incorrectly attributed as at-fault for an accident, and another accident where I was not even in the car). If things aren't moving fast enough, getting the ombudsman's office involved may help.
