I would say it was obviously the cars fault. However the whole driving thing seems so impromptu whever this place was, that I'm all confused about how things should work there.
It looks like the car in the left hand lane tried to turn across his lane of traffic and he took evasive action that resulted in him clipping the scooter.
If there had been a car or a dumb truck to his extreme right, he may have decided on brakes instead of the swerve. Scooters and bikes get the short end of it where visibility and mass are concerned.
