Not like that no, there's not enough space for 2 lines of vehicles which is the wording that allows us to do it on other streets. One could also argue it is "off road" since there's solid white lines
I haven't seen one, but there may be a bylaw ticket that applies to this. The section of the HTA that vrus is referring to, is 150: Passing to the right of a vehicle. If the area to the right is signed for parking, only, then "off roadway" may apply.
150. (1) The driver of a motor vehicle may overtake and pass to the right of another vehicle only where the movement can be made in safety and,
(a) the vehicle overtaken is making or about to make a left turn or its driver has signalled his or her intention to make a left turn;
(b) is made on a highway with unobstructed pavement of sufficient width for two or more lines of vehicles in each direction; or
(c) is made on a highway designated for the use of one-way traffic only. R.S.O. 1990, c. H.8, s. 150 (1).
Driving off roadway prohibited
(2) No driver of a motor vehicle shall overtake and pass another vehicle by driving off the roadway. R.S.O. 1990, c. H.8, s. 150 (2).
And then, as previously stated, there's always the R. v. Bunda style HTA 172 charge.
People still do 90+ on that road. Use to live on that street until last fall. Yes it is technically a no no and some of the morning ******* commuters will try and run you into the curb (happened when I was trying to pull in front of my building to park).
