quick question about fighting a reduced ticket

i have seen similar postings but nothing pertaining exactly like this. ticket was issued sometime in june or july

i was getting off the highway 427 and turning right onto the east mall. I did not see any speed signs what so ever. And when you look on google maps st view there is no signs posted. (but i drove by a couple days ago and it looks like there is brand new signs up)

Cop walks into my lane and ushers me to pull over. Showed me on the radar going 60-65 cant remember exactly. Told me it was a 40 zone. I was puzzled as it was right off the highway and is not a school zone. He brought me the ticket back and said he knocked it down to 15 over. The ticket does have the R on it. I already filed for a court date. just curious as to what you guys think i should do from here. Go fight it completely or go to court and plead guilty so it doesn't get bumped back to 20-25 over.

I wanted to hold off paying it so when i renewed my insurance in october this ticket wouldn't be on it (my insurance just dropped 700 by waiting) Not sure as to what plan of action I should take now.

Print out all the street view maps from google maps showing the last speed limit sign up to where you were pulled over, If there are signs saying the lower speed you could try to fight you were just following the last signs speed limit.

Can't testify as to when or by whom the photo was taken. Won't likely be accepted as evidence.

Street View printouts will not be accepted in court for VERY obvious reasons; pictures on Street View can be up to 4-5 years old; the best recourse would be to look at city by-laws as to when the new speed limits were in force, and when the signs were erected

but don't embarrass yourself bringing Google street-view printouts to court, they're equivalent to toilet paper

You must use some cheap TP, or have some very soft printer paper......

If you're going to present evidence in court, then you have to be able to testify as to its veracity. Take them yourself. If you can't answer questions about them, they are worth absolutely nothing.

If the speed limit changed there recently, then there will be records of it in the Toronto City Council meeting minutes, or in the city bylaws.

Your questions is EXACTLY the same as every other question asked when someone gets a ticket. Why the heck is yours any different?

It makes absolutely NO FRIGGEN DIFFERENCE if you get convicted of 15 over or 25 over, just a little extra fine and a few more points. WHO CARES? NOBODY!

Fight it as if your life depended on it. 2 months before your court date file a disclosure request so you can see the cops notes and come up with ways to poke holes in his version of what went down.

What Jamie said. Hunt down everything and anything you can find to back up your claim. Take pictures of the new signs showing brand new mounting hardware.

One problem I forsee is that the limit is 50 unless otherwise posted, so either way you were speeding.

Yep, and remember: Even if you were doing 51km/h, you're guilty. It doesn't even matter if he wrote 40 and you can prove you were in a 50, if you were doing 51 or over, your goose is cooked. Think of the charge just as "speeding", and the km/h over, is just the fine. The only way to be found not guilty (assuming you don't get off on the cop not showing up, incomplete disclosure, 11b, etc.) is if you can prove you weren't breaking the speed limit.

Let us know when you get your court date and we'll go from there.

Probably not recently I would guess. My friend just went to court less than a month ago, was charged "in a 50 zone" but we had photos to prove it was "in a 60 zone", the judge only agreed to amend down the charge so it was in a 60, said it's not critical error :(

Guess it's up to the judge or circumstances (he got the ticket right where it switches from 60 to 50).

Last year, but jurisdiction and the judge will dictate.

The first part was the same its just the sign thing I was curious about and the Google maps thing I was curious about. I filed and was waiting for my court date. I planned on asking for full disclosure. I have read quite a few of your posts and plan to follow your directions. NOT GOING DOWN WITHOUT A FIGHT!
 
so i got my court date for january 16th. I know its been stated to delay delay delay the court date if possible. I actually have my surgery for my knee booked in january so i really do need to push back the court date. Should i ask for full disclosure now? or after i reschedule for another court date?

You want to avoid delaying it through any fault of your own, but if you have surgery, I guess you have to move it (it'll be listed as your fault).

If you absolutely won't be able to make that court date, change it. If you think you could make it, request your disclosure Nov 16th. Remember to not put your phone number or e-mail address on the form.
