Parking ticket - trial date

I got a trial date in the mail for a ticket I was issued in sept 2012. Trial date is Oct 09, 2013.

I have some pictures of the parked bike that day. I was going to use it as evidence, but I think 11b could be filled since its going to be over an year.

What's the next step? Is it possible to ask for a disclosure for a parking ticket? :confused:
 
Lol, you must be broke. I'd gladly pay the $60 than spend my whole day in court. If it was a moving violation (speeding, etc.) I can understand. A $60 parking ticket? :lol:

Anyways, good luck fighting it.
 
before you go down the 11b route, just make sure the costs of filing (printing, binding, faxing) does not cost more than $30. binding two books alone is going to be $10, and it's going to cost a small forest to print those pages; if you have to pay to fax, it's going to be a fortune to get all those pages to the Attorney General of Canada in Ottawa; you may also have to pay a commissioner of oath to affirm some of your things

lets not forget the gas/parking/bus/taxi money involved into filing them as well... and this is all prior to your trial date

if you go to trial, the prosecutor will offer you 50% or more off the fine; you could get further reduced if you show the justice of peace you have financial difficulties when you plead guilty - maybe get a suspended sentence.

from experience, most of the private security guards who act as MLEOs when they write tickets; these guys are trained to write atleast the backside of the ticket worth of notes about the vehicle and what happened; depending on the jurisdiction when they file the ticket, they also file their notes as well.

the actual 311 MLEO guys just print out tickets for people parked on the streets, and in court they read w/e is written on the face of the ticket; but if it's a special situation, they will take notes especially if they're towing the vehicle

as for the pictures, this is some great advice from another forum (OHTA.ca)

These are some general guidelines for submitting photographs in court.

- Photographer must be present in the courtroom
- Photograph usually requires a time/date stamp
- Originals must be available to the court (if digital, "raw" format is used, plus a CD with the originals and the memory card)
- Photographs cannot be printed off your home computer, they must be printed by a retailer or professional photo store
- Have 3 copies of each photo, one for JP, prosecution and yourself
- Receipt from said retailer/photo store indicating date of printing or purchase must be brought to court

You cannot take a digital photograph, print it off at home and show up at court and expect that it will be accepted as evidence. That can be easily doctored with a photoshop program, and even if you swear up and down that you did not alter the photo's contents, any half-decent Prosecutor will get it excluded as unreliable.

In some cases, a higher standard is required for the photos to be accepted. If the photo is of a collision, for example, the photographer will usually have to be trained in the use of a camera.​

i'm curious though, what exactly was the infraction for a $60 fine? and how do you think your pictures will help?

how i'm picturing this, "car parks in the handicap space, moves his car to a regular space and takes a picture".

Well, it was the first day of classes and I was in a bit of a rush. This was my first time parking there, I parked on top of a white line.
These are the pictures from that day, sadly there aren't any timestamps.

Basically that fade line was the marker for the taxi standing area and the P parking. I got a ticket because I was parked past the 'no parking' sign.
I just hope the parking maid doesn't show and the ticket gets thrown out. Otherwise, i'll try to fight it with the picture and see if it helps.
 
Hate to be against ya bud, but don't motorcycles have to be parked at no more than a 45 degree angle to the curb? Might be a little more but I'm sure an expert can chime in on this.

That's immaterial in this case. He didn't get the ticket because of the angle.

In the first picture, there is a pole behind your bike. Is that the pole with the parking sign? It looks like you are outside the boundary!

Unfortunately the yellow marking on the ground is just paint... probably the work of the taxi people to mark their spot, the city would not mark it with yellow, and it is not the "official" boundary.
 
Oh, thanks. I forgot about the 45 degree parking.
Anything helps, I know $60 isn't a lot, but i'm hoping the meter guy doesn't show up to court.
Yes, the pole was the parking sign, I was in a rush and didn't see it in the morning.

Lesson learnt, from that day on I check all the signs carefully before parking.
