Parking Infraction: Park signed highway during prohibited times/days.

So I got a parking ticket in this wonderful city we live in, after parking like this for years ever since we won the right to park for free in green P zones on the street.

Apparently this constable must have a beef with that law or something and decided to get me on what can only be some sort of technicality. As seen in the photo I'm within the designated parking zone off the 4 lane highway and did give more then enough room between me and the vehicle in front of me to get out. (I know this because they were leaving when I came back to this ticket) However according to the officer I'm blocking the flow of traffic according to the ticket issued. Yet in what other circumstance other then parking would a vehicle be in motion on this section of road? The store owner where my bike was even said if he saw the officer ticketing my bike he would have questioned them as to why they were ticking my bike, which suggests other bikes have parked there without being ticketed. I have parked like this more then once, in a spot very much like this one, for years without getting a ticket. Why now?

Yes I am fighting it. Yes I am issuing a complaint.

Anyone else received/dealt with tickets like this in this type of scenario?
 
It's hard to see front the angle of the pic but was your bike in relation to the sign indicating "no parking to the right of this sign"?

If your bike WAS to the right of the sign as it appears that you've indicated, then even though it's cheesy, I guess it's a valid ticket.
 
Were you on the other side of the post with the parking signage?
 
I'd say I was in the middle of it, so front tire to the left of the sign and the back tire to right of it. It's a BS ticket, they're dinging me because they can. Not because I'm truly blocking or causing anyone else from parking there.

It may be a cheesy or BS ticket, but by your own admission, it's valid.
 
Wouldn't that only be a valid ticket if he was parked there outside of the designated hours?

The hours pertain to the left of the sign, the question here is to the right of the sign.

It seems likely that at least part of the bike was out of bounds.

Note that there are two "no parking" signs. The left one is the snow route no parking sign which has hours given on it. The right one has the little arrow on it and does NOT have hours given on it - that one is effective at all times.

If the ticket was actually for "... during prohibited times/days" it might actually be the wrong offence. It probably should have been for parking in a no-parking zone, period, with no mention of time. Not sure if that would help the case ...

edit: I should add that if the "... during prohibited times/days" ticket is valid then it's also valid for every other car parked on the street. It's only the sign with the arrow on it that's valid in that little corner.

That's what I was talking about. It's the incorrect ticket, and it'll be dismissed since the time and date are on it as well as location.
 
looks guilty to me,no parking to the right of the sign,been there myself in a car(half legal half illegal),I just payed the ticket.

You were in a designated parking area...arguably a parking lot. The charge should have been "park in parking lot, not designated area". I've had one or two of those, both won in court because I was a bike.

I think your chances of beating this are better than expected.

I think you have the wrong definition of "highway" in mind. He was parked on a road, not a parking lot and the term "highway" would apply.
 
Unfortunately if you're parked at all overlapping the sign post on which the no parking sign is posted, and by your own explanation you were, you're then guilty of the stated offence. I was going to post a picture of the sign, but BrianP beat me to it.

Your best bet is to file and hope that, like in so many other cases, your ticket gets dropped because of the volume of tickets issued.
