OJ Simpson selling murder weapon...

Hypothetical, if true, it is not Double Jeopardy... it is grounds for Crown Appeal of the not-guilty charge since evidence was not available at the time of trial (especially if it was the accused who hid it).

Pretty sure the case cant be reopened... and he cant be tried for the same thing twice.

Yes you can.

You can't be found guilty of the same crime twice but if new evidence becomes available you certainly can be re-tried. This is not a case of double jeopardy.

He wouldn't be charged with murder again.... the crown would appeal the original not-guilty verdict. Appeal is a different type of "trial".

An appeal will only be granted if evidence that was not available at the time of the trial is found/made aware of. Everyone knew the knife was somewhere, if it turns up that OJ hid it himself, they COULD apply (and would try to apply for an appeal).

Although the Statute of Limitations is different in Canada than the U.S. and per state, so whether the appeal is heard at all would depend on this. But general rule is if it was impossible to obtain or know of at the time, you can appeal.

Something like forgetting to serve/question a witness wouldn't be enough. It has to be new and unavailable at the time of trial.

Hence, why the 90's was infamous for a crapload of appeals because of the introduction/advancement of DNA evidence. (ie: Kenny Waters).

makes sense... you also have to keep in mind that the odds of the guy that just spent 5 million on this this "collectors" piece giving it up isn't very good.

If he doesn't play ball the Police will likely seize it, or charge him with obstruction of justice or something of the like (and he wouldn't do farely well in the general population..... this was a huge racial case and having the one guy who knows where the weapon is won't last very long lol). Lots of things they can do :p
 
This is all hypothetical, of course... assuming it's the real deal and the transaction actually takes place.

that's true... still amazing what people will do and how far they will go.

Wonder what kind of person would actually wanna dish out 5 mill for this thing though... if in fact its true.

Maybe to narc him out and willingly give it to police for a "reward"....

OR this guy is really an undercover government agent and the knife is actually being bought with taxpayer money so they can appeal it.
