no insurance ticket

a month ago i got a ticket for riding without insurance. my summons date is this thursday 18th of august. the situation is complicated. i tried to register and insure thebike but there was a lien on it so that didnt happen. stupidly enough i wanted to show my friends the newbike so i took it out the next day and got booked. no insurance, not registered, wrong plates, speeding 118 on dvp. anyway the thing is that was the first time i have ever been without insurance. ive been insuredfor 8 years on both car and bike. i screwed up yes but this ticket is 5000$ and will destroy my record. i madea mistake... i really need some advice on this one.

You really should have been preparing for this since you received the ticket. Imo, you should find a competent traffic lawyer. Preferably not a para-legal. Although RedLine, http://www.charged.ca/, is a highly recommended paralegal on this forum, not used them myself.

a paralegal wanted to charge me 600 to take on this ticket. she told me the summons date is just to set up a court date... and that i can do it myself...
 
ok. I'd still talk to/hire a lawyer and get some real legal advice. I have no idea what a fair price is for defending your charges but the consequences and cost of being found guilty will be very high. I'd suspect the only insurance you can get with a no insurance conviction would be facility and that is in the thousands of dollars per year. The advice you will get here can be useful it is not a substitute for real legal council....

i have no clue where to find a real lawyer for legal advice. also im not very comfortable financially atm... terrible...
 
Including the obvious insurance implications in the future it gets worse. The $5000 carries a 25% victim surcharge, making it $6250. What's worse is 5000 is the minimun, first offence carries a max of $25,000 plus surcharge, and one year suspension. Find a good lawyer yesterday, and do whatever it takes to find the money to pay for him/her.
 
I'm not a lawyer, but this seems pretty cut and dry to me. The cop pulled you over on a day where you're not going to be able to prove you had insurance. You might want to consult with Redline or a lawyer just to see what they think. And if you need to drive anywhere in the next five years, you might want to consider selling the bike to cover legal expenses.

That's a collection of pretty big "mistakes". The fact that you had no insurance, swapped plates and were speeding will not get you much sympathy from the judge. Hire a lawyer if you can manage it. The fine itself will be a small kick in the *** compared to the insurance implications for you over the next few years.
 
I'll check the classifids for the new posting. I'd like to say I feel for you but i don't and listen to what they say on here get a lawyer or you may not drive anything for awhile with your insurance costs.

Everyone is different but having a bike is expensive sometimes due to lack of judgement.
 
Given the thousands of dollars that this can ultimately cost you, both in direct fines and being put on Facility insurance, Paying up-front for a lawyer only makes sense. It will also be in the thousands, before you're done, but might ultimately result in you being able to drive in the near future.

Reading this has changed my mind. I got a bike the other month but because of $$ have not got license or insurance yet. Very tempted to take it out on the back roads I live on around here. After reading the situation you got it's going to remained parked in the garage. I had no idea it would be that much, good luck!

Good luck. Do not get OTT to represent you on these charges. You will get dicked around by them and the fine. I used them when I was young and dumb for the no insurance ticket. The charge is pretty cut and dry unless you can find a chick that works for your insurance company, bone her, and ask her to write you a policy that began before your charges.
Realistically the best you can possibly do is show the judge your strained financial situation and pray he/she will reduce the fine based on your financial hardship. Be prepared to pay out your a** for insurance for the next three year's after you are convicted.
I would actually sign up for insurance for what ever vehicle's you have now, cross your finger's nothing has stained your abstract yet, then cross your toes they don't look again at your abstract when renewal time comes around.
Remember if you are ever riding dirty again (which I highly do not recommend), do not do anything stupid that would give cause for a cop to run your plates or pull you over.
 
Not really pointed at the OP, but for those considering riding with no insurance...these fines are brutal and SHOULD be a deterrent, but also consider what would happen if you had a collision, even if you're not at fault. Financially devastating to say the least, life changing even. Not worth the aggravation
 
i talked with my insurance agent and she told me i'm covered for the first 15 days with my auto policy...
you are automatically covered for a new vehicle purchase for the first 2 weeks...
not sure what the details are, but you might want to check into this with your agent

i got one of these a few years back and its NOT good at all. 100% surcharge for 3 years. got the fine dropped to 1100 from 5gs but that doesnt help much on your record. Get a good lawyer, but even still....good luck.

So did I a few years back ( car, not bike )
I got a no insurance ticket/summons. I didn't get myself a lawyer, 'cause I knew I was screwed anyways.
No insurance is not a "small" thing, it's serious and that's how they take it.
That being said, I did get a chance to speak to the prosecutor and since it was my first time for no insurance, they dropped it from the standard 5000 to 2500.

do you have car insurance right now?
like posted above you are covered by your current policy on a new vehicle, also it states you have 6 days to transfer your plates over on a new vehicle.

if you dont have any insurance then your ****ed
 
zeniceguy, although I do agree that you have 6-7 days to transfer the ownership of a vehicle, I am pretty sure that *most* insurance companies will not automatically insure a new vehicle the minute you get it under one of your existing policies. (i say most because I have never had this feature from the different companies I have been with)

AFAIK, it needs to be called in and give them the information to get a quote, and either by signature or by phone, you can make that policy active which normally starts at midnight, and they'll email you a temporary insurance slip.
Then at that point your bike has insurance and you can then ride it around to get your safety and exchange plates/ownership and whatever.


@OP: Sell the bike to pay for a lawyer. Yeah it sucks but if you say you're not very financially able to get a lawyer right now, you have to choose whether you watch your bike collect dust in a garage for a few years, or still have the ability to drive your car next month.

This year when I sold my R6 and bought a ZX6R, I was covered for 15 days before I officially transferred everything and got the slips (even temporary ones).
I'm with Statefarm btw.

At the very least, call Redline get some advice on the matter. Absolutely get some kind of representation. The ramifications of these actions will haunt you for the next half decade otherwise.
