About a fender bender.

About a month ago I was rear ended.
The driver who hit me didn't want to claim insurance so I agree and we still exchanged out license and insurance info.

Since then I got a quote for repair and he agreed. But recently there was no more communication. I am wondering if he doesn't respond. How should I proceed?

It might be too late now. Whenever this happens and you don't want to go insurance route. Have this done within 48hrs or take it to collision centre.

A MONTH AGO? Why would you wait so long? You're probably SOL.

Last time my g/f got hit in a parking lot by a teenager, her dad came and we agreed to settle it without ins,but i told him...."i WILL report it withing 48hrs...so we are gonna hussle on this" Found three shops, got a quote, took the middle priced one, he went and paid for the work upfront and that was that.

From Ontario Collision Reporting Centre web site: http://www.collision-reporting-centre.com/q_a/
Looks like you can still report it---(bold highlights added by me)

Q. Is there a time limit to reporting about a car collision?
A. You should try your best to report the accident within 48 hours from the time the car accident had happened.

Q. Suppose I get hit from the rear and agree to allow the wrongful party to pay for the damages. After signing the paperwork indicating that he will cover the costs, which are below $1000.00, can I still make a report should he/she decides change his/her mind and refuse to pay for the damages?
A. If no one is hurt and the damage is under $1000.00 the report is not required by law. It would be wise to have everything documented by an official of the government for future references just in case one party decides to change their mind. The answer is Yes.

You have this persons address don't you... Go have a visit with a couple friends and baseball bats!

In all seriousness, go confront the person. See if you can get it resolved.

take all the info to a reporting center and start the process, contact your insurance agent (this is what you pay them for). If your asked "why didnt you report" if its in excess of $1000. tell them your not in the industry, how could you know what the cost would be like.

Your insurance co. fixes and chases his insurance co. Done. dont confront anybody, just get it fixed.

so, i am able to put my claim in.
My question now is, will this zero fault claim affect my future rates?
How does this affect the other party and his future rates?

Some has told me, my rates will be affected since i put a claim in.
Some has also me, no it won't.

anyone have insights about this?

This is what i would do if i were you, and it has worked for me in the past:

Go pay the person a visit and in a calm manner explain to them that a verbal agreement is as good as a written contract in canada.
Tell them that if they choose not to pay up that you will proceed with small claims court and you will proceed with the highest quote you can possibly find. Also you will ask to be reimbursed for every day that you miss work as a result of this (400-500 per day) 1 day to file paperwork, another to speak to the person who hit you, another couple for court dates, another 1 or 2 for quotes etc... you will also seek that he/she pay your court costs. Also they will have to take a couple days off work and attend court.

So option A pay up now like we agreed, or option B, see above.

:D

Wife's car was hit in a mall parking lot. The person that hit her was good enough to leave a note and when contacted an hour later they didn't want to go through insurance so I said the same thing to them, we will get a quote in the next few hours which we will scan and send to you via e-mail, and you need to be prepared to pay by the end of the day via electronic money trasfer (interac transfer) or we will report the collison.

Got the cash immediately after the quote. We just did one quote from the shop we usually use as it was our time being wasted.
