Need help just got into accident..

i was exiting the highway today and rear ended somebody who slammed on his brakes out of nowhere.. Bikes front end is gone and wont start now, his car rear bumper is dented a bit. The opp came and we made a report and parted ways. I have liability only insurance and when i called them they said they wouldnt cover it because i am at fault. I didnt get a ticket or charged with anything. I was wondering what steps i can take or what i can do now. Or is there anyway i can get my insurance to cover because i cannot afford to repair it, and the cop didnt say i was at fault. please help!
 
You were found at fault through the insurance fault book.
Best bet is to watch kijiji, ebay and places like that for parts because be prepared to have your insurance go up and nothing paid out.
 
Insurance will get police report and it will state u rear ended the guy. Ur pooched for insurance. The only way u could swing it is if his insurance paid for it... Which it won't. Like he said kijiji or eBay...or put it up for sale.... It's lose lose really. Sorry to hear your situation.

You are "at fault" in the eyes of the insurance company, since you rear ended the other person. This is completely separate from getting charged by a police officer for the accident.

Unfortunately, you only have liability insurance to cover damage to the car. You are on the hook for your own damage.


Keep a look out for parts on kijiji and cancel the liability part of your insurance to save some $$ while you fix it.
 
hmm so i shouldn't have called at all, now it is on file and they arent doing anything. Im going to be screwed on insurance for the next few years since ill have an at fault. They said theyll be sending an adjuster for some injury claim i think? Its a really busy week for me since im leaving the country for a week so its hard to make time for all this.I am pretty Mad about getting scammed $340 for the tow too.. Such a stressful time. Thanks for the replies everyone. Not sure how much everything would cost.
 
The other members are correct -- the insurance company determines fault, not the police. If you rear end someone, you are automatically deemed at fault based on the Fault Determination Rules (which are detailed in the Ontario Insurance Act). If you are at fault, the damages to your own vehicle would be covered by your own policy's Collision coverage (which unfortunately you didn't buy). If you are NOT at fault, then the damages to your vehicle would be covered by your own policy's Direct Compensation Property Damage (DCPD) coverage, which is mandatory in Ontario and has a $0 deductible.

Ideal scenario:
Do not have the police called. If you can afford to compensate them for the damage, have them get an estimate and settle it directly.

I wouldn't stress out too much about your rates just yet. It may not be as bad as you think.. only one way to find out.

I don't know why the adjuster is checking out your bike.. it might be a part of the insurance investigation so he can note that it was infact your bike that caused the damage to the car.

Since they already have it on file, I doubt you can get them to "reverse" it.

What kind of bike do you have? How easy can you source parts?

Technically, since it is no-fault insurance in Ontario, the other guy's insurance company will pay for the damage to his car even though he wasn't at fault. This has no bearing on the assignment of fault and future premium changes though -- the not-at-fault operator will see no premium increase.

Be glad the tow truck only charged you $340 for the tow. Tow bills of $1000 or even more aren't unheard of.

Ohhh so that's what it means. So will the not-at-fault driver be on record as having a claim with that insurer? If yes, then won't that affect his future premiums? If no, then what difference does it make to the end user if insurers operate under "no fault" rules?
 
Sure, but I meant as in why do we need to know. It's not like we have a choice "I'll take the no fault insurance please" or "it's no fault insurance so that means I have to..." what exactly?

We don't really need to know, it's an internal thing.

You are always better off not calling insurance if the other party would agree to you paying out of pocket.

If it makes you feel any better, add up the money you saved by not buying comprehensive and see if that even comes close to what you might have to pay for the damage. What bike?

It really doesn't matter much to the client -- it's more of a technicality. The term "no-fault insurance" is often misunderstood.
