so i got laid off almost two months ago, due to downsizing of the company, and now i finally got a job. But when i asked my manager for reference he is saying i can't represent the company as a reference but can be a personal reference!!??!!!

i mean wtf???? i didn't quit, i didn't get fire, so whats the big deal???

Perhaps he doesn't have the authority to represent the company. Ask him if there is someone else in the company who could authorize it, or write you the letter.

yeah with big corporations they don't. Usually goes to HR and they give the reference. Same for me when I worked at the bank.

Some companies won't give references (good OR bad), other than confirming that you were employed there between certain dates.

Is he at least willing to say that he was your manager? A personal reference is fine. If an employer wants to verify your previous employment they'll just contact HR. Like others have said, a lot of companies have a policy of not giving references. Probably to discourage people from leaving and to protect their reputation.

Maybe he doesn't want to give a bad reference, so he is choosing not to give one at all?
Were you a bad employee?
LOL

He did get laid off....

Seriously though, don't take offense. The company probably has a policy against giving references as it could lead to a potential liability so they have HR do it. It is better to have HR do it as long as you had solid performance reviews. Whoever is asking for the reference will know nothing is BS'd and what they get is solid so I wouldn't worry about it.

I am pretty sure it is just a company policy. All HR can really do is varify your job title, start and finish of employment and that's about it. I highly doubt they could take about your job performance either due to liability reasons. Which also means they can't give you a negative review which works out to your advantage if you weren't a strong performer. I'm in an HR program at the moment :p
Although if you want more than what HR is going to provide your manager is going out of his way to provide you with a reference so you can always use that.

lol, no. my boss was actually upset because of losing me. and i finished all the projects they gave me.

One of my ex-employers refused to give a reference too...well at least one manager did.

Then we got a new manager who said would give me a reference although they're not supposed to. I worked for a large software development company.

Company policy, as others have said. Too many former employees are suing companies for what they perceive as "erroneous" references. So you said you finished every project that you were given. What if the new employer asked "Was x ever late for work" "Did they ever leave early" and you can see that your reference could go bad. So all managers are told to refer to HR, who will just confirm employment and not much else. Look at is as a good thing.

Typical for big companies. Personal reference from manager plus employment record from HR is about all you can expect.

Legally, the HR department is only obligated to confirm dates of employment.

There are many reasons managers are restricted from giving references on behalf of the "company". He is being nice enough for to serve as a "personal" reference, because any information beyond your dates of employment & reason for termination is subjective to him and based on personal opinion/observation.

No reason to get bent out of shape. This is very common.

If it is true, they can talk about it all they want. It is only an issue when they lie.

This is correct. However, the rationale is that if they don't say anything, they can't be accused of lying.

Yes correct. For example, if your former employer gives you a good reference and you get the job with the new company and you do not perform well for any reason, they might look back ands sue your former employer for misrepresentation so they don't give good or bad references because of that reason. They just don't want to deal with that type of liability, don't take it personally that's just how big companies conduct this type of business.
