License Suspension Question

Hello,

My friend got his license (G2) suspended for 30days in the summer for driving 162km/h in a 100 zone on 401. And he just got back to Canada after he got a sentence from the court. He never received a disclosure or anything since he hired TT Legal Services (?) to handle the case for him while he was gone. Paralegal sent him a letter, explaining what the fine and due date is, and the offences that he got booked.

He just got a Driver's Abstract printed today, and it says; "License Status: Cancelled".

My guess is that he missed the interview (informal discussion on why his license should not be suspended) at MTO for having 6 demerit points on a G2.

But how does suspension work ? Did he have to surrender his Driver's Lic when he got suspended ? Or did he have to get a new one after suspension was over ?

Any ideas why his license is cancelled ?

You're probably right, but the OP should ask the paralegals he hired, or the MTO directly.
 
Did he pay the fine in the requested timeframe?

No, but he is still in the 180days period.

Now we are thinking that the cancellation cause is he missed re-examination which he had to do after license suspension.

If he never signed for any registered letters telling him his license was suspended and he still has physical possession of the license, it's still valid until he gets pulled over or signs for any registered letters. I drove with a suspended license for 2.5 years until I was pulled over. No biggie they just took my license and my buddie drove the car home and I started my 6mo suspension from that point.

I realize this probably isn't the solution you're looking for.

After your license has been suspended you have to go to an MTO office and pay a $150 re-instatement fee.

If he hasn't done that, it's all he probably needs to do to have a license again.

I've had to do it, and as soon as you pay the fee, you're good to go.

yea...because it doesn't make sense. After you've gotten a suspension where you actually have to turn in your license to the ministry you have a certain timeframe to do so, if you don't I think the suspension is further extended.

So I find it odd you were supposed to have turned in your license months before and when you got caught there were no repercussions.

If they can't prove you were notified to turn in your license, they just take it from you at the time they are able to and start your suspension. It may have changed now that I see someone posted that even if you don't answer the registered mail they assume you've been notified.

This is no longer the case!!!!!!!!! The MTO sends out notification of suspension which is "deemed served" 7 days later. Get caught driving after that 7 days and you'll find yourself likely getting charged with drive suspended. I believe you're required to return the license but failing to do so doesn't mean that you're still licensed, nor does it mean the duration of the suspension is extended.

The 30 day suspension is automatic upon being convicted of a novice license offense.

Once the suspension expires, you have to visit the MTO and pay $150 to get the license re-instated.

they don't send registered mail anymore (no one signs for that stuff cause no good news comes by registered mail). my friend was caught with a suspended licence (unknowingly) and the crown was going for jail time.

The norm on the 3rd conviction.

This turned out to be the exact situation. Thanks a lot =) My friend is now driving again (always under the speed limit lol)
 
this was his first time with a suspended licence, lots of seat belt tickets but that's another thing entirely

Until your friend shows you their abstract, I'd doubt the story being given to you. The Crown won't go for incarceration on the first conviction for a simple drive suspended conviction... there was likely something else in play.
 
I may be wrong but I thought there was still a three day reinstatement period you have to wait out , from the time you pay your $150 re register fee?
 
Nope, the 3 day wait is between when you pay the fine and when you can pay the $150 reinstatement fee. You can drive right away as soon as it's reinstated.

Good to know. I had heard of that delay but didn't know how it was applied.

well i know a couple other people that the crown was asking for jail time for being caught with a suspended licence (co-workers). it happens a lot in my area, and while it's often the first driving suspended ticket they usually have a history of plenty of other tickets. Sadly I know plenty of people driving with either no/suspended licence or they're going around on their G1 with no additional driver.
