Why is talking/texting on a cell phone only a $155 fine and puking on private property $300 which isn't far from a careless driving charge of $450?

I'm guessing that part of it is one is a by-law where the municipality set the rate, whereas the others are provincial.

For puking the fine should be the $155, for fine for talking/texting should be driving over the phone.
